88 AN ACT
99 relating to the removal of a public school student from the
1010 classroom for engaging in conduct involving the possession of
1111 certain prohibited substances.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 37.006, Education Code, is amended by
1414 amending Subsection (a) and adding Subsection (a-1) to read as
1515 follows:
1616 (a) A student shall be removed from class and placed in a
1717 disciplinary alternative education program as provided by Section
1818 37.008 if the student:
1919 (1) engages in conduct involving a public school that
2020 contains the elements of the offense of false alarm or report under
2121 Section 42.06, Penal Code, or terroristic threat under Section
2222 22.07, Penal Code; or
2323 (2) subject to Subsection (a-1), commits the following
2424 on or within 300 feet of school property, as measured from any point
2525 on the school's real property boundary line, or while attending a
2626 school-sponsored or school-related activity on or off of school
2727 property:
2828 (A) engages in conduct punishable as a felony;
2929 (B) engages in conduct that contains the elements
3030 of the offense of assault under Section 22.01(a)(1), Penal Code;
3131 (C) sells, gives, or delivers to another person
3232 or possesses or uses or is under the influence of:
3333 (i) marihuana or a controlled substance, as
3434 defined by Chapter 481, Health and Safety Code, or by 21 U.S.C.
3535 Section 801 et seq.; or
3636 (ii) a dangerous drug, as defined by
3737 Chapter 483, Health and Safety Code;
3838 (D) sells, gives, or delivers to another person
3939 an alcoholic beverage, as defined by Section 1.04, Alcoholic
4040 Beverage Code, commits a serious act or offense while under the
4141 influence of alcohol, or possesses, uses, or is under the influence
4242 of an alcoholic beverage;
4343 (E) engages in conduct that contains the elements
4444 of an offense relating to an abusable volatile chemical under
4545 Sections 485.031 through 485.034, Health and Safety Code;
4646 (F) engages in conduct that contains the elements
4747 of the offense of public lewdness under Section 21.07, Penal Code,
4848 or indecent exposure under Section 21.08, Penal Code; or
4949 (G) engages in conduct that contains the elements
5050 of the offense of harassment under Section 42.07(a)(1), (2), (3),
5151 or (7), Penal Code, against an employee of the school district.
5252 (a-1) Notwithstanding Subsection (a), a student may but is
5353 not required to be removed from class and placed in a disciplinary
5454 alternative education program as provided by Section 37.008 if:
5555 (1) the student engages in conduct that contains
5656 elements of the offense of possession of a controlled substance
5757 under Section 481.116 or 481.1161, Health and Safety Code; and
5858 (2) the substance possessed as described by
5959 Subdivision (1) is an amount less than one gram of
6060 tetrahydrocannabinols or cannabinol derivatives that is contained
6161 in:
6262 (A) an electronic or other device that simulates
6363 smoking by using a mechanical heating element, battery, or
6464 electronic circuit to deliver a substance described by this
6565 subdivision to the individual inhaling from the device; or
6666 (B) a consumable liquid solution or other
6767 material aerosolized or vaporized during the use of an electronic
6868 or other device described by Paragraph (A).
6969 SECTION 2. This Act applies beginning with the 2023-2024
7070 school year.
7171 SECTION 3. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2023.
