55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirements for the renewal of a driver's license,
88 personal identification certificate, commercial driver's license,
99 or commercial learner's permit for a sex offender.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 62.060(b), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (b) The person shall annually renew [in person] each
1414 driver's license or personal identification certificate issued by
1515 the department to the person, including each renewal, duplicate, or
1616 corrected license or certificate, until the person's duty to
1717 register under this chapter expires.
1818 SECTION 2. Section 521.103(a), Transportation Code, is
1919 amended to read as follows:
2020 (a) The department may issue an original or renewal personal
2121 identification certificate to a person whose driver's license or
2222 personal identification certificate record indicates that the
2323 person is subject to the registration requirements of Chapter 62,
2424 Code of Criminal Procedure, only if the person:
2525 (1) applies in person for the issuance of an initial
2626 [a] certificate under this section; and
2727 (2) pays a fee of $20.
2828 SECTION 3. Section 521.272(a), Transportation Code, is
2929 amended to read as follows:
3030 (a) The department may issue an original or renewal driver's
3131 license to a person whose driver's license or personal
3232 identification certificate record indicates that the person is
3333 subject to the registration requirements of Chapter 62, Code of
3434 Criminal Procedure, only if the person:
3535 (1) applies in person for the issuance of an initial
3636 [a] license under this section; and
3737 (2) pays the fee required by Section 521.421(h).
3838 SECTION 4. Section 521.274(b), Transportation Code, is
3939 amended to read as follows:
4040 (b) A rule adopted under this section:
4141 (1) may prescribe eligibility standards for renewal
4242 under this section;
4343 (2) [may not permit a person subject to the
4444 registration requirements under Chapter 62, Code of Criminal
4545 Procedure, to register by mail or electronic means;
4646 [(3)] may not permit renewal by mail or electronic
4747 means of a driver's license of a person who is 79 years of age or
4848 older; and
4949 (3) [(4)] must allow for the renewal of a driver's
5050 license by electronic means, regardless of when the license
5151 expires, of:
5252 (A) a person who:
5353 (i) is on active duty in the armed forces of
5454 the United States; and
5555 (ii) is absent from the state; and
5656 (B) the spouse or dependent child of a person
5757 described by Paragraph (A).
5858 SECTION 5. Section 522.033(a), Transportation Code, is
5959 amended to read as follows:
6060 (a) The department may issue an original or renewal
6161 commercial driver's license or commercial learner's permit to a
6262 person whose driver's license or personal identification
6363 certificate record indicates that the person is subject to the
6464 registration requirements of Chapter 62, Code of Criminal
6565 Procedure, only if the person is otherwise eligible for the
6666 commercial driver's license or commercial learner's permit and:
6767 (1) applies in person for the issuance of an initial
6868 [a] license or permit under this section; and
6969 (2) pays a fee of:
7070 (A) $20 for a commercial driver's license; or
7171 (B) $24 for a commercial learner's permit.
7272 SECTION 6. The changes in law made by this Act apply only to
7373 a driver's license, personal identification certificate,
7474 commercial driver's license, or commercial learner's permit issued
7575 or renewed on or after the effective date of this Act. A driver's
7676 license, personal identification certificate, commercial driver's
7777 license, or commercial learner's permit issued or renewed before
7878 the effective date of this Act is governed by the law in effect when
7979 the license, certificate, or permit was issued or renewed, and the
8080 former law is continued in effect for that purpose.
8181 SECTION 7. This Act takes effect September 1, 2023.
