7 | 7 | | relating to the requirements for the renewal of a driver's license, |
---|
8 | 8 | | personal identification certificate, commercial driver's license, |
---|
9 | 9 | | or commercial learner's permit for a sex offender. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Article 62.060(b), Code of Criminal Procedure, |
---|
12 | 12 | | is amended to read as follows: |
---|
13 | 13 | | (b) The person shall annually renew [in person] each |
---|
14 | 14 | | driver's license or personal identification certificate issued by |
---|
15 | 15 | | the department to the person, including each renewal, duplicate, or |
---|
16 | 16 | | corrected license or certificate, until the person's duty to |
---|
17 | 17 | | register under this chapter expires. |
---|
18 | 18 | | SECTION 2. Section 521.103(a), Transportation Code, is |
---|
19 | 19 | | amended to read as follows: |
---|
20 | 20 | | (a) The department may issue an original or renewal personal |
---|
21 | 21 | | identification certificate to a person whose driver's license or |
---|
22 | 22 | | personal identification certificate record indicates that the |
---|
23 | 23 | | person is subject to the registration requirements of Chapter 62, |
---|
24 | 24 | | Code of Criminal Procedure, only if the person: |
---|
25 | 25 | | (1) applies in person for the issuance of an initial |
---|
26 | 26 | | [a] certificate under this section; and |
---|
27 | 27 | | (2) pays a fee of $20. |
---|
28 | 28 | | SECTION 3. Section 521.272(a), Transportation Code, is |
---|
29 | 29 | | amended to read as follows: |
---|
30 | 30 | | (a) The department may issue an original or renewal driver's |
---|
31 | 31 | | license to a person whose driver's license or personal |
---|
32 | 32 | | identification certificate record indicates that the person is |
---|
33 | 33 | | subject to the registration requirements of Chapter 62, Code of |
---|
34 | 34 | | Criminal Procedure, only if the person: |
---|
35 | 35 | | (1) applies in person for the issuance of an initial |
---|
36 | 36 | | [a] license under this section; and |
---|
37 | 37 | | (2) pays the fee required by Section 521.421(h). |
---|
38 | 38 | | SECTION 4. Section 521.274(b), Transportation Code, is |
---|
39 | 39 | | amended to read as follows: |
---|
40 | 40 | | (b) A rule adopted under this section: |
---|
41 | 41 | | (1) may prescribe eligibility standards for renewal |
---|
42 | 42 | | under this section; |
---|
43 | 43 | | (2) [may not permit a person subject to the |
---|
44 | 44 | | registration requirements under Chapter 62, Code of Criminal |
---|
45 | 45 | | Procedure, to register by mail or electronic means; |
---|
46 | 46 | | [(3)] may not permit renewal by mail or electronic |
---|
47 | 47 | | means of a driver's license of a person who is 79 years of age or |
---|
48 | 48 | | older; and |
---|
49 | 49 | | (3) [(4)] must allow for the renewal of a driver's |
---|
50 | 50 | | license by electronic means, regardless of when the license |
---|
51 | 51 | | expires, of: |
---|
52 | 52 | | (A) a person who: |
---|
53 | 53 | | (i) is on active duty in the armed forces of |
---|
54 | 54 | | the United States; and |
---|
55 | 55 | | (ii) is absent from the state; and |
---|
56 | 56 | | (B) the spouse or dependent child of a person |
---|
57 | 57 | | described by Paragraph (A). |
---|
58 | 58 | | SECTION 5. Section 522.033(a), Transportation Code, is |
---|
59 | 59 | | amended to read as follows: |
---|
60 | 60 | | (a) The department may issue an original or renewal |
---|
61 | 61 | | commercial driver's license or commercial learner's permit to a |
---|
62 | 62 | | person whose driver's license or personal identification |
---|
63 | 63 | | certificate record indicates that the person is subject to the |
---|
64 | 64 | | registration requirements of Chapter 62, Code of Criminal |
---|
65 | 65 | | Procedure, only if the person is otherwise eligible for the |
---|
66 | 66 | | commercial driver's license or commercial learner's permit and: |
---|
67 | 67 | | (1) applies in person for the issuance of an initial |
---|
68 | 68 | | [a] license or permit under this section; and |
---|
69 | 69 | | (2) pays a fee of: |
---|
70 | 70 | | (A) $20 for a commercial driver's license; or |
---|
71 | 71 | | (B) $24 for a commercial learner's permit. |
---|
72 | 72 | | SECTION 6. The changes in law made by this Act apply only to |
---|
73 | 73 | | a driver's license, personal identification certificate, |
---|
74 | 74 | | commercial driver's license, or commercial learner's permit issued |
---|
75 | 75 | | or renewed on or after the effective date of this Act. A driver's |
---|
76 | 76 | | license, personal identification certificate, commercial driver's |
---|
77 | 77 | | license, or commercial learner's permit issued or renewed before |
---|
78 | 78 | | the effective date of this Act is governed by the law in effect when |
---|
79 | 79 | | the license, certificate, or permit was issued or renewed, and the |
---|
80 | 80 | | former law is continued in effect for that purpose. |
---|
81 | 81 | | SECTION 7. This Act takes effect September 1, 2023. |
---|
