6	6	AN ACT
7	7	relating to providing mental health services and mental health
8	8	education to public school students at school-based health centers.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 38.051(a), Education Code, is amended to
11	11	read as follows:
12	12	(a) A school district in this state may, if the district
13	13	identifies the need, design a model in accordance with this
14	14	subchapter for the delivery of cooperative health care programs for
15	15	students and their families and may compete for grants awarded
16	16	under this subchapter. The model may provide for the delivery of:
17	17	(1) conventional health services;
18	18	(2) mental health services; and
19	19	(3) disease prevention of emerging health threats that
20	20	are specific to the district.
21	21	SECTION 2. Section 38.058, Education Code, is amended to
22	22	read as follows:
23	23	Sec. 38.058. HEALTH EDUCATION AND HEALTH CARE ADVISORY
24	24	COUNCIL. (a) The board of trustees of a school district or the
25	25	governing body of an open-enrollment charter school may establish
26	26	and appoint members to a local health education and health care
27	27	advisory council to make recommendations to the district or school
28	28	on the establishment of school-based health centers to provide
29	29	health care services, including mental health services, and to
30	30	assist the district or school in ensuring that local community
31	31	values are reflected in the operation of each center and in the
32	32	provision of health education and mental health education.
33	33	(b) A majority of the members of the council must be parents
34	34	of students enrolled in the school district or open-enrollment
35	35	charter school. In addition to the appointees who are parents of
36	36	students, the board of trustees or governing body shall also
37	37	appoint at least one person from each of the following groups:
38	38	(1) classroom teachers;
39	39	(2) school administrators;
40	40	(3) school counselors;
41	41	(4) health care professionals licensed or certified to
42	42	practice in this state;
43	43	(5) mental health care professionals licensed to
44	44	practice in this state;
45	45	(6) the clergy;
46	46	(7) [(6)] law enforcement;
47	47	(8) [(7)] the business community;
48	48	(9) [(8)] senior citizens; and
49	49	(10) [(9)] students.
50	50	SECTION 3. Section 38.063(c), Education Code, is amended to
51	51	read as follows:
52	52	(c) All health care programs should be designed to meet the
53	53	following goals:
54	54	(1) reducing student absenteeism;
55	55	(2) increasing a student's ability to meet the
56	56	student's academic potential; and
57	57	(3) stabilizing the physical and mental well-being of
58	58	a student.
59	59	SECTION 4. The board of trustees of a school district or the
60	60	governing body of an open-enrollment charter school that has
61	61	established a local health education and health care advisory
62	62	council under Section 38.058, Education Code, shall appoint to the
63	63	council a mental health professional licensed in this state, as
64	64	required by the change in law made by this Act, as soon as
65	65	practicable and not later than January 1, 2024.
66	66	SECTION 5. This Act takes effect immediately if it receives
67	67	a vote of two-thirds of all the members elected to each house, as
68	68	provided by Section 39, Article III, Texas Constitution. If this
69	69	Act does not receive the vote necessary for immediate effect, this
70	70	Act takes effect September 1, 2023.
