66 AN ACT
77 relating to the use of automated traffic control systems by certain
88 municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 542.2035, Transportation Code, is
1111 amended to read as follows:
1212 Sec. 542.2035. LIMITATION ON MUNICIPALITIES. (a) Except
1313 as provided by Subsection (a-1), a [A] municipality may not
1414 implement or operate an automated traffic control system with
1515 respect to a highway or street under its jurisdiction for the
1616 purpose of enforcing compliance with posted speed limits. The
1717 attorney general shall enforce this subsection.
1818 (a-1) A municipality with a population of two million or
1919 more may implement or operate an automated traffic control system
2020 with respect to a highway or street under its jurisdiction for the
2121 purpose of enforcing compliance with posted speed limits in a
2222 school crossing zone.
2323 (b) In this section:
2424 (1) [,] "Automated [automated] traffic control
2525 system" means a photographic device, radar device, laser device, or
2626 other electrical or mechanical device designed to:
2727 (A) [(1)] record the speed of a motor vehicle;
2828 and
2929 (B) [(2)] obtain one or more photographs or other
3030 recorded images of:
3131 (i) [(A)] the vehicle;
3232 (ii) [(B)] the license plate attached to
3333 the vehicle; or
3434 (iii) [(C)] the operator of the vehicle.
3535 (2) "School crossing zone" has the meaning assigned by
3636 Section 541.302.
3737 SECTION 2. Chapter 707, Transportation Code, is amended by
3838 adding Section 707.022 to read as follows:
3939 Sec. 707.022. MUNICIPAL SCHOOL CROSSING ZONE EXCEPTION.
4040 This chapter does not apply to an automated traffic control system,
4141 as defined by Section 542.2035, that is authorized by Section
4242 542.2035(a-1).
4343 SECTION 3. This Act takes effect September 1, 2023.
