| 8 | 8 | | municipalities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 542.2035, Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 542.2035. LIMITATION ON MUNICIPALITIES. (a) Except |
|---|
| 13 | 13 | | as provided by Subsection (a-1), a [A] municipality may not |
|---|
| 14 | 14 | | implement or operate an automated traffic control system with |
|---|
| 15 | 15 | | respect to a highway or street under its jurisdiction for the |
|---|
| 16 | 16 | | purpose of enforcing compliance with posted speed limits. The |
|---|
| 17 | 17 | | attorney general shall enforce this subsection. |
|---|
| 18 | 18 | | (a-1) A municipality with a population of two million or |
|---|
| 19 | 19 | | more may implement or operate an automated traffic control system |
|---|
| 20 | 20 | | with respect to a highway or street under its jurisdiction for the |
|---|
| 21 | 21 | | purpose of enforcing compliance with posted speed limits in a |
|---|
| 22 | 22 | | school crossing zone. |
|---|
| 23 | 23 | | (b) In this section: |
|---|
| 24 | 24 | | (1) [,] "Automated [automated] traffic control |
|---|
| 25 | 25 | | system" means a photographic device, radar device, laser device, or |
|---|
| 26 | 26 | | other electrical or mechanical device designed to: |
|---|
| 27 | 27 | | (A) [(1)] record the speed of a motor vehicle; |
|---|
| 28 | 28 | | and |
|---|
| 29 | 29 | | (B) [(2)] obtain one or more photographs or other |
|---|
| 30 | 30 | | recorded images of: |
|---|
| 31 | 31 | | (i) [(A)] the vehicle; |
|---|
| 32 | 32 | | (ii) [(B)] the license plate attached to |
|---|
| 33 | 33 | | the vehicle; or |
|---|
| 34 | 34 | | (iii) [(C)] the operator of the vehicle. |
|---|
| 35 | 35 | | (2) "School crossing zone" has the meaning assigned by |
|---|
| 36 | 36 | | Section 541.302. |
|---|
| 37 | 37 | | SECTION 2. Chapter 707, Transportation Code, is amended by |
|---|
| 38 | 38 | | adding Section 707.022 to read as follows: |
|---|
| 39 | 39 | | Sec. 707.022. MUNICIPAL SCHOOL CROSSING ZONE EXCEPTION. |
|---|
| 40 | 40 | | This chapter does not apply to an automated traffic control system, |
|---|
| 41 | 41 | | as defined by Section 542.2035, that is authorized by Section |
|---|
| 42 | 42 | | 542.2035(a-1). |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
