| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter E-1, Chapter 2154, Occupations Code, |
|---|
| 13 | 13 | | is amended by adding Section 2154.2215 to read as follows: |
|---|
| 14 | 14 | | Sec. 2154.2215. FIREWORKS SALES BUILDINGS IN CERTAIN |
|---|
| 15 | 15 | | COUNTIES. (a) This section applies only to a county with a |
|---|
| 16 | 16 | | population of more than 1.5 million in which more than 75 percent of |
|---|
| 17 | 17 | | the population lives in a single municipality. |
|---|
| 18 | 18 | | (b) In addition to the requirements of Section 2154.221, a |
|---|
| 19 | 19 | | fireworks sales building of an indoor retail fireworks site located |
|---|
| 20 | 20 | | in or directly adjacent to a residential real estate subdivision |
|---|
| 21 | 21 | | with at least 3,300 homes that is governed by a property owners |
|---|
| 22 | 22 | | association must: |
|---|
| 23 | 23 | | (1) be, at the time the building's construction |
|---|
| 24 | 24 | | commences, a minimum distance of 100 feet from any inhabited |
|---|
| 25 | 25 | | building; |
|---|
| 26 | 26 | | (2) have, at a minimum, one-hour fire-rated exterior |
|---|
| 27 | 27 | | walls with minimum three-fourths-hour fire-rated protected |
|---|
| 28 | 28 | | openings; and |
|---|
| 29 | 29 | | (3) have a complete automatic fire sprinkler system |
|---|
| 30 | 30 | | installed in accordance with the provisions of the edition of the |
|---|
| 31 | 31 | | National Fire Protection Association, Standard 13, "Standard for |
|---|
| 32 | 32 | | the Installation of Sprinkler Systems," as adopted and amended by |
|---|
| 33 | 33 | | the commissioner. |
|---|
| 34 | 34 | | SECTION 2. Section 2154.2215, Occupations Code, as added by |
|---|
| 35 | 35 | | this Act, applies only to a fireworks sales building of an indoor |
|---|
| 36 | 36 | | retail fireworks site for which construction commences on or after |
|---|
| 37 | 37 | | September 1, 2023. A fireworks sales building of an indoor retail |
|---|
| 38 | 38 | | fireworks site for which construction commenced before that date is |
|---|
| 39 | 39 | | governed by the law in effect before September 1, 2023, and the |
|---|
| 40 | 40 | | former law is continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
