88 AN ACT
99 relating to requirements for fireworks sales buildings of indoor
1010 retail fireworks sites in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E-1, Chapter 2154, Occupations Code,
1313 is amended by adding Section 2154.2215 to read as follows:
1414 Sec. 2154.2215. FIREWORKS SALES BUILDINGS IN CERTAIN
1515 COUNTIES. (a) This section applies only to a county with a
1616 population of more than 1.5 million in which more than 75 percent of
1717 the population lives in a single municipality.
1818 (b) In addition to the requirements of Section 2154.221, a
1919 fireworks sales building of an indoor retail fireworks site located
2020 in or directly adjacent to a residential real estate subdivision
2121 with at least 3,300 homes that is governed by a property owners
2222 association must:
2323 (1) be, at the time the building's construction
2424 commences, a minimum distance of 100 feet from any inhabited
2525 building;
2626 (2) have, at a minimum, one-hour fire-rated exterior
2727 walls with minimum three-fourths-hour fire-rated protected
2828 openings; and
2929 (3) have a complete automatic fire sprinkler system
3030 installed in accordance with the provisions of the edition of the
3131 National Fire Protection Association, Standard 13, "Standard for
3232 the Installation of Sprinkler Systems," as adopted and amended by
3333 the commissioner.
3434 SECTION 2. Section 2154.2215, Occupations Code, as added by
3535 this Act, applies only to a fireworks sales building of an indoor
3636 retail fireworks site for which construction commences on or after
3737 September 1, 2023. A fireworks sales building of an indoor retail
3838 fireworks site for which construction commenced before that date is
3939 governed by the law in effect before September 1, 2023, and the
4040 former law is continued in effect for that purpose.
4141 SECTION 3. This Act takes effect September 1, 2023.
