| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Sections 91.001(6) and (7), Business & Commerce |
|---|
| 15 | 15 | | Code, are amended to read as follows: |

| 16 | 16 | | (6) "Rental agreement" means an agreement for 180 [30] |
|---|
| 17 | 17 | | days or less that states the terms governing the use of a private |
|---|
| 18 | 18 | | passenger vehicle rented by a rental company. |
|---|
| 19 | 19 | | (7) "Rental company" means a person in the business of |
|---|
| 20 | 20 | | renting private passenger vehicles to the public for 180 [30] days |
|---|
| 21 | 21 | | or less. The term does not include a person who holds a license |
|---|
| 22 | 22 | | under Chapter 2301, Occupations Code, and whose primary business |
|---|
| 23 | 23 | | activity is not renting private passenger vehicles. |

| 24 | 24 | | SECTION 2. Sections 91.001(6) and (7), Business & Commerce |
|---|
| 25 | 25 | | Code, as amended by this Act, apply only to a rental agreement |
|---|
| 26 | 26 | | entered into on or after the effective date of this Act. A rental |
|---|
| 27 | 27 | | agreement entered into before the effective date of this Act is |
|---|
| 28 | 28 | | governed by the law in effect on the date the contract was entered |
|---|
| 29 | 29 | | into, and the former law is continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2023. |
