99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the regulation of private passenger vehicle rental
1212 companies.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 91.001(6) and (7), Business & Commerce
1515 Code, are amended to read as follows:
1616 (6) "Rental agreement" means an agreement for 180 [30]
1717 days or less that states the terms governing the use of a private
1818 passenger vehicle rented by a rental company.
1919 (7) "Rental company" means a person in the business of
2020 renting private passenger vehicles to the public for 180 [30] days
2121 or less. The term does not include a person who holds a license
2222 under Chapter 2301, Occupations Code, and whose primary business
2323 activity is not renting private passenger vehicles.
2424 SECTION 2. Sections 91.001(6) and (7), Business & Commerce
2525 Code, as amended by this Act, apply only to a rental agreement
2626 entered into on or after the effective date of this Act. A rental
2727 agreement entered into before the effective date of this Act is
2828 governed by the law in effect on the date the contract was entered
2929 into, and the former law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2023.
