55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transfer of certain malt beverages between two or
88 more licensed premises operating under the same general ownership
99 or management.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 62, Alcoholic Beverage Code, is amended
1212 by adding Section 62.085 to read as follows:
1313 Sec. 62.085. TRANSFER OF MALT BEVERAGES. (a) The holder of
1414 a brewer's license may transfer malt beverages produced under the
1515 license between any of the license holder's licensed brewery
1616 premises, including a facility operating under an alternating
1717 brewery proprietorship or contract brewing arrangement as provided
1818 by Section 62.14, during the hours provided by Section 105.051,
1919 subject to rules prescribed by the commission.
2020 (b) The holder of a brewer's license may not transport malt
2121 beverages under Subsection (a) unless:
2222 (1) the license holder provides the commission with a
2323 description, as required by the commission, of each motor vehicle
2424 used by the license holder to transport malt beverages; and
2525 (2) each motor vehicle is plainly marked or lettered
2626 to indicate that it is being used by the license holder to transport
2727 malt beverages.
2828 (c) When transporting malt beverages under this section,
2929 the holder of a brewer's license may not violate the motor carrier
3030 laws of this state.
3131 (d) For purposes of Section 62.122, a malt beverage
3232 transported under this section is considered to be brewed on the
3333 premises to which the malt beverage is transported.
3434 SECTION 2. Section 69.11, Alcoholic Beverage Code, is
3535 amended to read as follows:
3636 Sec. 69.11. EXCHANGE OR TRANSPORTATION OF MALT BEVERAGES
3737 BETWEEN LICENSED PREMISES UNDER SAME OWNERSHIP. (a) Except as
3838 provided by Subsection (b), the [The] owner of two or more licensed
3939 retail premises may not exchange or transport malt beverages
4040 between them.
4141 (b) Malt [unless all of the conditions set out in Section
4242 24.04 are met, except that malt] beverages may be transferred
4343 between:
4444 (1) two licensed retail premises that are both covered
4545 by wine only package store permits as provided in Section 24.04;
4646 (2) two licensed retail premises that are both covered
4747 by package store permits as provided in Section 22.08; or
4848 (3) two licensed brewpubs operating under the same
4949 general management or ownership as provided in Section 74.12.
5050 SECTION 3. Chapter 74, Alcoholic Beverage Code, is amended
5151 by adding Section 74.12 to read as follows:
5252 Sec. 74.12. TRANSFER OF BEVERAGES. (a) The holder of a
5353 brewpub license operating more than one brewpub as authorized by
5454 Section 74.01(b) may transfer malt beverages brewed under the
5555 license between any of the license holder's brewpubs during the
5656 hours provided by Section 105.051, subject to rules prescribed by
5757 the commission.
5858 (b) The holder of a brewpub license may not transport malt
5959 beverages under Subsection (a) unless:
6060 (1) the license holder provides the commission with a
6161 description, as required by the commission, of each motor vehicle
6262 used by the license holder to transport malt beverages; and
6363 (2) each motor vehicle is plainly marked or lettered
6464 to indicate that it is being used by the license holder to transport
6565 malt beverages.
6666 (c) When transporting malt beverages under this section,
6767 the holder of a brewpub license may not violate the motor carrier
6868 laws of this state.
6969 (d) For purposes of Sections 74.03 and 74.08, a malt
7070 beverage transported under this section is considered to be brewed
7171 by the brewpub to which the malt beverage is transported.
7272 SECTION 4. This Act takes effect September 1, 2023.
