| 7 | 7 | | relating to the approval of open-enrollment charter schools. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 12.101(b-0), Education Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (b-0) The commissioner shall notify the State Board of |
|---|
| 12 | 12 | | Education of each charter the commissioner proposes to grant under |
|---|
| 13 | 13 | | this subchapter. Unless, before the 90th day after the date on |
|---|
| 14 | 14 | | which the board receives the notice from the commissioner, |
|---|
| 15 | 15 | | two-thirds [a majority] of the total membership [members] of the |
|---|
| 16 | 16 | | board [present and voting] vote against the grant of that charter, |
|---|
| 17 | 17 | | the commissioner's proposal to grant the charter takes effect. The |
|---|
| 18 | 18 | | board may not deliberate or vote on any grant of a charter that is |
|---|
| 19 | 19 | | not proposed by the commissioner. |

| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2023. |
