| 5 | 5 | | relating to the transfer of certain public school students who are |

| 6 | 6 | | children of certain military servicemembers. |
|---|
| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter B, Chapter 25, Education Code, is |
|---|
| 9 | 9 | | amended by adding Section 25.0344 to read as follows: |
|---|
| 10 | 10 | | Sec. 25.0344. TRANSFER OF STUDENTS WHO ARE CHILDREN OF |
|---|
| 11 | 11 | | SERVICEMEMBERS. (a) In this section, "servicemember" means an |
|---|
| 12 | 12 | | active duty member of the armed forces of the United States, a |
|---|
| 13 | 13 | | reserve component of the armed forces of the United States, or the |
|---|
| 14 | 14 | | Texas National Guard. |
|---|
| 15 | 15 | | (b) On request of a servicemember who is a parent of or |
|---|
| 16 | 16 | | person standing in parental relation to a student, the board of |
|---|
| 17 | 17 | | trustees of a school district or the board's designee shall |
|---|
| 18 | 18 | | transfer the student to another district campus or to another |
|---|
| 19 | 19 | | school district under an agreement under Section 25.035. |
|---|
| 20 | 20 | | (c) A transfer under this section must be to the campus or |
|---|
| 21 | 21 | | school district, as applicable, selected by the servicemember |
|---|
| 22 | 22 | | making the request. |
|---|
| 23 | 23 | | (d) A school district is not required to provide |
|---|
| 24 | 24 | | transportation to a student who transfers to another campus or |
|---|
| 25 | 25 | | school district under this section. |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2023. |
