66 AN ACT
77 relating to the eligibility of certain counties to create a civil
88 service system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 158.002, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 158.002. ELIGIBLE COUNTIES. A county with a
1313 population of 500,000 [190,000] or more may, in accordance with
1414 this subchapter, create a county civil service system to include
1515 all the employees of the county who are not exempted from the system
1616 by the express terms or judicial interpretations of this subchapter
1717 or by the operation of Subchapter B.
1818 SECTION 2. Section 158.0025(a), Local Government Code, is
1919 amended to read as follows:
2020 (a) This section applies only to a county with a population
2121 of 500,000 [190,000] or more, other than:
2222 (1) a county that has created a civil service system
2323 under this subchapter to include those employees of the county
2424 described by Section 158.002; or
2525 (2) a county in which the sheriff's department is
2626 eligible to create a civil service system under Subchapter B.
2727 SECTION 3. The changes in law made by this Act apply only to
2828 the eligibility of a county to create a civil service system on or
2929 after the effective date of this Act. The eligibility of a county
3030 to create a civil service system before the effective date of this
3131 Act is governed by the law in effect on the date the system was
3232 created, and the former law is continued in effect for that purpose.
3333 SECTION 4. This Act takes effect September 1, 2023.
