55 relating to the enforcement of commercial motor vehicle safety
66 standards in certain municipalities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 644.101(b), Transportation Code, is
99 amended to read as follows:
1010 (b) A police officer of any of the following municipalities
1111 is eligible to apply for certification under this section:
1212 (1) a municipality with a population of 50,000 or
1313 more;
1414 (2) a municipality with a population of 25,000 or more
1515 any part of which is located in a county with a population of
1616 500,000 or more;
1717 (3) a municipality with a population of less than
1818 25,000:
1919 (A) any part of which is located in a county with
2020 a population of 3.3 million; and
2121 (B) that contains or is adjacent to an
2222 international port;
2323 (4) a municipality with a population of at least
2424 34,000 that is located in a county that borders two or more states;
2525 (5) a municipality any part of which is located in a
2626 county bordering the United Mexican States;
2727 (6) a municipality with a population of less than
2828 5,000 that is located:
2929 (A) adjacent to a bay connected to the Gulf of
3030 Mexico; and
3131 (B) in a county adjacent to a county with a
3232 population greater than 3.3 million;
3333 (7) a municipality that is located:
3434 (A) within 25 miles of an international port; and
3535 (B) in a county that does not contain a highway
3636 that is part of the national system of interstate and defense
3737 highways and is adjacent to a county with a population greater than
3838 3.3 million;
3939 (8) a municipality with a population of less than
4040 8,500 that:
4141 (A) is the county seat; and
4242 (B) contains a highway that is part of the
4343 national system of interstate and defense highways;
4444 (9) a municipality located in a county with a
4545 population between 60,000 and 66,000 adjacent to a bay connected to
4646 the Gulf of Mexico;
4747 (10) a municipality with a population of more than
4848 40,000 and less than 50,000 that is located in a county with a
4949 population of more than 285,000 and less than 300,000 that borders
5050 the Gulf of Mexico;
5151 (11) a municipality with a population between 32,000
5252 and 50,000 that is located entirely in a county that:
5353 (A) has a population of less than 250,000;
5454 (B) is adjacent to two counties that each have a
5555 population of more than 1.2 million; and
5656 (C) contains two highways that are part of the
5757 national system of interstate and defense highways;
5858 (12) a municipality with a population of more than
5959 3,000 and less than 10,000 that:
6060 (A) contains a highway that is part of the
6161 national system of interstate and defense highways; and
6262 (B) is located in a county with a population
6363 between 150,000 and 155,000;
6464 (13) a municipality with a population of less than
6565 75,000 that is located in three counties, at least one of which has
6666 a population greater than 3.3 million;
6767 (14) a municipality with a population between 14,000
6868 and 17,000 that:
6969 (A) contains three or more numbered United States
7070 highways; and
7171 (B) is located in a county that is adjacent to a
7272 county with a population of more than 200,000; [or]
7373 (15) a municipality with a population of less than
7474 50,000 that is located in:
7575 (A) a county that generated $20 million or more
7676 in tax revenue collected under Chapters 201 and 202, Tax Code, from
7777 oil and gas production during the preceding state fiscal year; or
7878 (B) a county that is adjacent to two or more
7979 counties described by Paragraph (A); or
8080 (16) a municipality with a population of more than
8181 2,000 that is located in a county:
8282 (A) with a population of less than 200,000; and
8383 (B) that borders:
8484 (i) another state; and
8585 (ii) the Gulf Intracoastal Waterway.
8686 SECTION 2. This Act takes effect September 1, 2023.
