55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to investigations and actions by district or county
88 attorneys in connection with the deceptive trade practice of
99 charging exorbitant or excessive prices for necessities during a
1010 declared disaster.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 17.463, Business &
1313 Commerce Code, is amended to read as follows:
1414 Sec. 17.463. LIMITED AUTHORITY OF DISTRICT AND COUNTY
1515 ATTORNEYS TO INVESTIGATE AND PROSECUTE CERTAIN DECEPTIVE ACTS OR
1616 PRACTICES [PRODUCTION, SALE, DISTRIBUTION, OR PROMOTION OF CERTAIN
1717 SYNTHETIC SUBSTANCES].
1818 SECTION 2. Section 17.463, Business & Commerce Code, is
1919 amended by amending Subsections (a) and (f) and adding Subsection
2020 (g) to read as follows:
2121 (a) This section applies only to an act described by Section
2222 17.46(b)(27) or (31) [17.46(b)(31)].
2323 (f) Notwithstanding any other law, in an action brought by a
2424 district or county attorney under this section for a violation of
2525 Section 17.46(b)(31), all settlements or penalties collected by the
2626 district or county attorney shall be divided between the state and
2727 the county in which the attorney brought suit, with:
2828 (1) 50 percent of the amount collected paid to the
2929 comptroller for deposit to the credit of the basic civil legal
3030 services account established by Section 51.943, Government Code;
3131 and
3232 (2) 50 percent of the amount collected paid to the
3333 county shall be deposited by the county in a segregated account and
3434 the funds shall be used only for law enforcement, public health
3535 programs, or drug abuse prevention programs.
3636 (g) Notwithstanding any other law, in an action brought by a
3737 district or county attorney under this section for a violation of
3838 Section 17.46(b)(27), all settlements or penalties collected by the
3939 district or county attorney shall be divided between the state and
4040 the county in which the attorney brought suit, with:
4141 (1) 50 percent of the amount collected paid to the
4242 comptroller for deposit to the credit of the basic civil legal
4343 services account established by Section 51.943, Government Code;
4444 and
4545 (2) 50 percent of the amount collected paid to the
4646 county.
4747 SECTION 3. The changes in law made by this Act apply only to
4848 an act or practice that occurs on or after the effective date of
4949 this Act. An act or practice that occurs before the effective date
5050 of this Act is governed by the law in effect on the date the act or
5151 practice occurred, and the former law is continued in effect for
5252 that purpose.
5353 SECTION 4. This Act takes effect September 1, 2023.
