77 relating to quarantine leave for certain public safety employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 607, Government Code, is amended by
1010 adding Subchapter D to read as follows:
1111 SUBCHAPTER D. QUARANTINE LEAVE FOR CERTAIN PUBLIC SAFETY EMPLOYEES
1212 Sec. 607.151. DEFINITIONS. (a) In this subchapter:
1313 (1) "Detention officer" means an individual employed
1414 by the state to ensure the safekeeping of prisoners and the security
1515 of a state penal institution in this state.
1616 (2) "Emergency medical technician" means an
1717 individual who is:
1818 (A) certified as an emergency medical technician
1919 under Chapter 773, Health and Safety Code; and
2020 (B) employed by the state.
2121 (3) "Firefighter" means a paid employee of the state
2222 who:
2323 (A) holds a position that requires substantial
2424 knowledge of firefighting;
2525 (B) has met the requirements for certification by
2626 the Texas Commission on Fire Protection under Chapter 419; and
2727 (C) performs a function listed in Section
2828 143.003(4)(A), Local Government Code.
2929 (4) "Health authority" has the meaning assigned by
3030 Section 121.021, Health and Safety Code.
3131 (5) "Ordered to quarantine or isolate" means any
3232 circumstance in which a person is not permitted to continue working
3333 due to:
3434 (A) a written or verbal directive by a health
3535 authority or the employee's supervisor ordering the person to
3636 refrain from reporting to duty after displaying symptoms of a
3737 communicable disease; or
3838 (B) a written or verbal directive by a health
3939 authority or the employee's supervisor ordering the person to
4040 refrain from reporting to duty after being exposed to a
4141 communicable disease that is a presumptive illness under this
4242 chapter.
4343 (6) "Peace officer" means an individual described by
4444 Article 2.12, Code of Criminal Procedure, who is elected for,
4545 employed by, or appointed by the state.
4646 (b) Notwithstanding Section 607.001, in this subchapter,
4747 "public safety employee" means a detention officer, emergency
4848 medical technician, firefighter, or peace officer.
4949 Sec. 607.152. PAID QUARANTINE LEAVE FOR CERTAIN PUBLIC
5050 SAFETY EMPLOYEES. (a) A state agency that employs public safety
5151 employees shall develop and implement a paid quarantine leave
5252 policy for public safety employees who are ordered to quarantine or
5353 isolate.
5454 (b) A paid quarantine leave policy must provide that a
5555 public safety employee ordered to quarantine or isolate receive:
5656 (1) all employment benefits and compensation,
5757 including leave accrual, pension benefits, and health benefit plan
5858 benefits for the duration of the leave; and
5959 (2) reimbursement for reasonable costs related to the
6060 quarantine, including lodging, medical, and transportation.
6161 (c) The state agency may not reduce a public safety
6262 employee's sick leave balance, vacation leave balance, or other
6363 paid leave balance in connection with paid quarantine leave taken
6464 in accordance with a policy adopted under this section.
6565 SECTION 2. Section 180.008(a), Local Government Code, as
6666 added by Chapter 685 (H.B. 2073), Acts of the 87th Legislature,
6767 Regular Session, 2021, is amended by adding Subdivision (4-a) to
6868 read as follows:
6969 (4-a) "Ordered to quarantine or isolate" means any
7070 circumstance in which a person is not permitted to continue working
7171 due to:
7272 (A) a written or verbal directive by a health
7373 authority or the employee's supervisor ordering the person to
7474 refrain from reporting to duty after displaying symptoms of a
7575 communicable disease; or
7676 (B) a written or verbal directive by a health
7777 authority or the employee's supervisor ordering the person to
7878 refrain from reporting to duty after being exposed to a
7979 communicable disease that is a presumptive illness under this
8080 chapter.
8181 SECTION 3. Section 180.008(b), Local Government Code, as
8282 added by Chapter 685 (H.B. 2073), Acts of the 87th Legislature,
8383 Regular Session, 2021, is amended to read as follows:
8484 (b) The governing body of a political subdivision shall
8585 develop and implement a paid quarantine leave policy for fire
8686 fighters, peace officers, detention officers, and emergency
8787 medical technicians who are employed by, appointed by, or elected
8888 for the political subdivision and ordered to quarantine or isolate
8989 [due to a possible or known exposure to a communicable disease while
9090 on duty].
9191 SECTION 4. This Act takes effect immediately if it receives
9292 a vote of two-thirds of all the members elected to each house, as
9393 provided by Section 39, Article III, Texas Constitution. If this
9494 Act does not receive the vote necessary for immediate effect, this
9595 Act takes effect September 1, 2023.
