7 | 7 | | relating to the establishment of and funding for additional program |
---|
8 | 8 | | of all-inclusive care for the elderly (PACE) sites; making an |
---|
9 | 9 | | appropriation. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
---|
12 | 12 | | is amended by adding Section 32.0534 to read as follows: |
---|
13 | 13 | | Sec. 32.0534. ADDITIONAL PACE PROGRAM SITES. (a) The |
---|
14 | 14 | | commission shall establish three PACE program sites that are in |
---|
15 | 15 | | addition to the PACE program sites operating before September 1, |
---|
16 | 16 | | 2023. Each of the additional sites must: |
---|
17 | 17 | | (1) have capacity to serve a maximum of 300 program |
---|
18 | 18 | | slots; and |
---|
19 | 19 | | (2) be administered by an entity with available |
---|
20 | 20 | | facility space and demonstrated administrative capacity. |
---|
21 | 21 | | (b) A PACE program site established under Subsection (a) |
---|
22 | 22 | | must: |
---|
23 | 23 | | (1) support the goals of: |
---|
24 | 24 | | (A) increased access to health care services; |
---|
25 | 25 | | (B) options for eligible individuals; and |
---|
26 | 26 | | (C) improved public health outcomes; |
---|
27 | 27 | | (2) comply with Section 32.053 and all regulatory |
---|
28 | 28 | | requirements; and |
---|
29 | 29 | | (3) be approved as a provider agency by the Centers for |
---|
30 | 30 | | Medicare and Medicaid Services. |
---|
31 | 31 | | (c) If money appropriated by the legislature to the |
---|
32 | 32 | | commission for purposes of this section is insufficient to fund the |
---|
33 | 33 | | additional slots described by Subsection (a) for a state fiscal |
---|
34 | 34 | | biennium, the executive commissioner shall submit a written request |
---|
35 | 35 | | to the Legislative Budget Board and the governor for approval to |
---|
36 | 36 | | transfer money appropriated to the commission for the biennium for |
---|
37 | 37 | | other purposes to fund the additional slots. The request is |
---|
38 | 38 | | considered approved unless the Legislative Budget Board or the |
---|
39 | 39 | | governor issues a written disapproval of the request not later than |
---|
40 | 40 | | the 30th business day after the date Legislative Budget Board staff |
---|
41 | 41 | | conclude a review of the request and forward the review to the chair |
---|
42 | 42 | | of the house appropriations committee, the chair of the senate |
---|
43 | 43 | | finance committee, the speaker of the house of representatives, and |
---|
44 | 44 | | the lieutenant governor. Any request for additional information |
---|
45 | 45 | | the Legislative Budget Board makes tolls the counting of the 30 |
---|
46 | 46 | | business days. |
---|
47 | 47 | | (d) On the request of the commission, the Legislative Budget |
---|
48 | 48 | | Board, or the governor, a PACE program provider shall provide |
---|
49 | 49 | | information related to the provider's actual costs, caseloads, and |
---|
50 | 50 | | services for purposes of this section. |
---|
51 | 51 | | SECTION 2. The amount of $16.48 million is appropriated |
---|
52 | 52 | | from the general revenue fund to the Health and Human Services |
---|
53 | 53 | | Commission for the state fiscal year beginning September 1, 2023, |
---|
54 | 54 | | for the purpose of establishing additional program of all-inclusive |
---|
55 | 55 | | care for the elderly (PACE) sites in accordance with Section |
---|
56 | 56 | | 32.0534, Human Resources Code, as added by this Act. |
---|
57 | 57 | | SECTION 3. If before implementing any provision of this Act |
---|
58 | 58 | | a state agency determines that a waiver or authorization from a |
---|
59 | 59 | | federal agency is necessary for implementation of that provision, |
---|
60 | 60 | | the agency affected by the provision shall request the waiver or |
---|
61 | 61 | | authorization and may delay implementing that provision until the |
---|
62 | 62 | | waiver or authorization is granted. |
---|
63 | 63 | | SECTION 4. This Act takes effect September 1, 2023. |
