55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of and funding for additional program
88 of all-inclusive care for the elderly (PACE) sites; making an
99 appropriation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.0534 to read as follows:
1313 Sec. 32.0534. ADDITIONAL PACE PROGRAM SITES. (a) The
1414 commission shall establish three PACE program sites that are in
1515 addition to the PACE program sites operating before September 1,
1616 2023. Each of the additional sites must:
1717 (1) have capacity to serve a maximum of 300 program
1818 slots; and
1919 (2) be administered by an entity with available
2020 facility space and demonstrated administrative capacity.
2121 (b) A PACE program site established under Subsection (a)
2222 must:
2323 (1) support the goals of:
2424 (A) increased access to health care services;
2525 (B) options for eligible individuals; and
2626 (C) improved public health outcomes;
2727 (2) comply with Section 32.053 and all regulatory
2828 requirements; and
2929 (3) be approved as a provider agency by the Centers for
3030 Medicare and Medicaid Services.
3131 (c) If money appropriated by the legislature to the
3232 commission for purposes of this section is insufficient to fund the
3333 additional slots described by Subsection (a) for a state fiscal
3434 biennium, the executive commissioner shall submit a written request
3535 to the Legislative Budget Board and the governor for approval to
3636 transfer money appropriated to the commission for the biennium for
3737 other purposes to fund the additional slots. The request is
3838 considered approved unless the Legislative Budget Board or the
3939 governor issues a written disapproval of the request not later than
4040 the 30th business day after the date Legislative Budget Board staff
4141 conclude a review of the request and forward the review to the chair
4242 of the house appropriations committee, the chair of the senate
4343 finance committee, the speaker of the house of representatives, and
4444 the lieutenant governor. Any request for additional information
4545 the Legislative Budget Board makes tolls the counting of the 30
4646 business days.
4747 (d) On the request of the commission, the Legislative Budget
4848 Board, or the governor, a PACE program provider shall provide
4949 information related to the provider's actual costs, caseloads, and
5050 services for purposes of this section.
5151 SECTION 2. The amount of $16.48 million is appropriated
5252 from the general revenue fund to the Health and Human Services
5353 Commission for the state fiscal year beginning September 1, 2023,
5454 for the purpose of establishing additional program of all-inclusive
5555 care for the elderly (PACE) sites in accordance with Section
5656 32.0534, Human Resources Code, as added by this Act.
5757 SECTION 3. If before implementing any provision of this Act
5858 a state agency determines that a waiver or authorization from a
5959 federal agency is necessary for implementation of that provision,
6060 the agency affected by the provision shall request the waiver or
6161 authorization and may delay implementing that provision until the
6262 waiver or authorization is granted.
6363 SECTION 4. This Act takes effect September 1, 2023.
