88 AN ACT
99 relating to veterans placed on community supervision or confined in
1010 the Texas Department of Criminal Justice.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 501.024(b), Government Code, is amended
1313 to read as follows:
1414 (b) The department shall:
1515 (1) in consultation with the Texas Veterans
1616 Commission, investigate and verify the veteran status of each
1717 inmate by using the best available federal data; and
1818 (2) use the data described by Subdivision (1) to
1919 assist inmates who are veterans in applying for:
2020 (A) federal benefits or compensation for which
2121 the inmates may be eligible under a program administered by the
2222 United States Department of Veterans Affairs; and
2323 (B) state benefits or compensation for which the
2424 inmates may be eligible under any state law or program.
2525 SECTION 2. Subchapter C, Chapter 501, Government Code, is
2626 amended by adding Section 501.1021 to read as follows:
2727 Sec. 501.1021. REENTRY AND REINTEGRATION SERVICES FOR
2828 VETERANS. (a) The department shall develop a comprehensive plan to
2929 ensure the successful reentry and reintegration into the community
3030 following discharge or release on parole or to mandatory
3131 supervision from the department of inmates whose veteran status has
3232 been verified by the department under Section 501.024(b)(1). The
3333 reentry and reintegration plan developed under this section must:
3434 (1) utilize all benefits that the inmate is eligible
3535 for as determined by the department under Section 501.024(b)(2) to
3636 provide for the following, as applicable, after the inmate's
3737 discharge or release on parole or to mandatory supervision:
3838 (A) housing;
3939 (B) employment;
4040 (C) education;
4141 (D) financial support for the inmate's family;
4242 and
4343 (E) medical or mental health care; and
4444 (2) require the department to maintain written
4545 documentation in the inmate's file that describes each benefit the
4646 inmate is eligible for and how the plan utilizes the benefit.
4747 (b) The department may contract with private vendors or
4848 other entities to implement the comprehensive reentry and
4949 reintegration plan as required by this section.
5050 SECTION 3. Chapter 509, Government Code, is amended by
5151 adding Section 509.0042 to read as follows:
5252 Sec. 509.0042. VETERANS BENEFITS PLAN. The division shall
5353 require each department to develop and implement a comprehensive
5454 plan to:
5555 (1) determine if a defendant placed on community
5656 supervision is a veteran; and
5757 (2) assist the defendant in obtaining any federal or
5858 state veterans benefits for which the defendant is eligible to
5959 provide for the following, as applicable, during the defendant's
6060 term of community supervision:
6161 (A) housing;
6262 (B) employment;
6363 (C) education;
6464 (D) financial support for the defendant's
6565 family; and
6666 (E) medical or mental health care.
6767 SECTION 4. This Act takes effect September 1, 2023.
