66 AN ACT
77 relating to the board of directors of the Eastland Memorial
88 Hospital District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1023.053, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 1023.053. QUALIFICATIONS FOR OFFICE. (a) To be
1313 eligible to be a candidate for or to serve as a director, a person
1414 must be:
1515 (1) a district resident; and
1616 (2) a qualified voter.
1717 (b) An employee or medical staff member of the district may
1818 not serve as a director.
1919 SECTION 2. Section 1023.054(a), Special District Local Laws
2020 Code, is amended to read as follows:
2121 (a) If a [A] vacancy occurs in the office of director, the
2222 remaining directors shall appoint a director [shall be filled] for
2323 the unexpired term [at the next regular election].
2424 SECTION 3. The changes in law made by this Act to the
2525 qualifications required for membership of the board of directors of
2626 the Eastland Memorial Hospital District do not affect the
2727 entitlement of a director serving on the board immediately before
2828 the effective date of this Act to continue to carry out the
2929 functions of the board for the remainder of the director's term. The
3030 changes in law apply only to a member of the board of directors
3131 elected or appointed on or after the effective date of this Act.
3232 This Act does not prohibit a person who is a member of the board on
3333 the effective date of this Act from being reelected or reappointed
3434 to the board if the person has the qualifications required for
3535 membership under Section 1023.053, Special District Local Laws
3636 Code, as amended by this Act.
3737 SECTION 4. This Act takes effect September 1, 2023.
