| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1023.053, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 1023.053. QUALIFICATIONS FOR OFFICE. (a) To be |
|---|
| 13 | 13 | | eligible to be a candidate for or to serve as a director, a person |
|---|
| 14 | 14 | | must be: |
|---|
| 15 | 15 | | (1) a district resident; and |
|---|
| 16 | 16 | | (2) a qualified voter. |
|---|
| 17 | 17 | | (b) An employee or medical staff member of the district may |
|---|
| 18 | 18 | | not serve as a director. |
|---|
| 19 | 19 | | SECTION 2. Section 1023.054(a), Special District Local Laws |
|---|
| 20 | 20 | | Code, is amended to read as follows: |
|---|
| 21 | 21 | | (a) If a [A] vacancy occurs in the office of director, the |
|---|
| 22 | 22 | | remaining directors shall appoint a director [shall be filled] for |
|---|
| 23 | 23 | | the unexpired term [at the next regular election]. |
|---|
| 24 | 24 | | SECTION 3. The changes in law made by this Act to the |
|---|
| 25 | 25 | | qualifications required for membership of the board of directors of |
|---|
| 26 | 26 | | the Eastland Memorial Hospital District do not affect the |
|---|
| 27 | 27 | | entitlement of a director serving on the board immediately before |
|---|
| 28 | 28 | | the effective date of this Act to continue to carry out the |
|---|
| 29 | 29 | | functions of the board for the remainder of the director's term. The |
|---|
| 30 | 30 | | changes in law apply only to a member of the board of directors |
|---|
| 31 | 31 | | elected or appointed on or after the effective date of this Act. |
|---|
| 32 | 32 | | This Act does not prohibit a person who is a member of the board on |
|---|
| 33 | 33 | | the effective date of this Act from being reelected or reappointed |
|---|
| 34 | 34 | | to the board if the person has the qualifications required for |
|---|
| 35 | 35 | | membership under Section 1023.053, Special District Local Laws |
|---|
| 36 | 36 | | Code, as amended by this Act. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2023. |
