55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain laws governing public
88 school requirements to a school district of innovation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12A.004(a), Education Code, is amended
1111 to read as follows:
1212 (a) A local innovation plan may not provide for the
1313 exemption of a district designated as a district of innovation from
1414 the following provisions of this title:
1515 (1) a state or federal requirement applicable to an
1616 open-enrollment charter school operating under Subchapter D,
1717 Chapter 12;
1818 (2) Subchapters A, C, D, and E, Chapter 11, except that
1919 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2020 Section 11.162;
2121 (3) Chapters 21 and 22;
2222 (4) class size limit requirements under Section
2323 25.112;
2424 (5) state curriculum and graduation requirements
2525 adopted under Chapter 28;
2626 (6) discipline and law and order under Chapter 37; and
2727 (7) [(4)] academic and financial accountability and
2828 sanctions under Chapters 39 and 39A.
2929 SECTION 2. Section 12A.004(a), Education Code, as amended
3030 by this Act, applies to each local innovation plan adopted under
3131 Chapter 12A, Education Code, regardless of whether the plan was
3232 adopted before, on, or after the effective date of this Act. A
3333 local innovation plan adopted or renewed before the effective date
3434 of this Act must comply with Section 12A.004(a), Education Code, as
3535 amended by this Act, not later than September 1, 2023.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2023.
