55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the delivery of cottage food by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 437.001(2-b), Health and Safety Code, is
1010 amended to read as follows:
1111 (2-b) "Cottage food production operation" means an
1212 individual, operating out of the individual's home, who:
1313 (A) produces at the individual's home, subject to
1414 Section 437.0196:
1515 (i) a baked good that is not a time and
1616 temperature control for safety food, as defined by Section
1717 437.0196;
1818 (ii) candy;
1919 (iii) coated and uncoated nuts;
2020 (iv) unroasted nut butters;
2121 (v) fruit butters;
2222 (vi) a canned jam or jelly;
2323 (vii) a fruit pie;
2424 (viii) dehydrated fruit or vegetables,
2525 including dried beans;
2626 (ix) popcorn and popcorn snacks;
2727 (x) cereal, including granola;
2828 (xi) dry mix;
2929 (xii) vinegar;
3030 (xiii) pickled fruit or vegetables,
3131 including beets and carrots, that are preserved in vinegar, brine,
3232 or a similar solution at an equilibrium pH value of 4.6 or less;
3333 (xiv) mustard;
3434 (xv) roasted coffee or dry tea;
3535 (xvi) a dried herb or dried herb mix;
3636 (xvii) plant-based acidified canned goods;
3737 (xviii) fermented vegetable products,
3838 including products that are refrigerated to preserve quality;
3939 (xix) frozen raw and uncut fruit or
4040 vegetables; or
4141 (xx) any other food that is not a time and
4242 temperature control for safety food, as defined by Section
4343 437.0196;
4444 (B) has an annual gross income of $50,000 or less
4545 from the sale of food described by Paragraph (A);
4646 (C) sells the foods produced under Paragraph (A)
4747 only directly to consumers; and
4848 (D) delivers products to the consumer:
4949 (i) at the point of sale or another location
5050 designated by the consumer; or
5151 (ii) by mail.
5252 SECTION 2. Section 437.0194(b), Health and Safety Code, is
5353 amended to read as follows:
5454 (b) A cottage food production operation may sell a food
5555 described by Section 437.001(2-b)(A) in this state through the
5656 Internet or by mail order only if[:
5757 [(1) the consumer purchases the food through the
5858 Internet or by mail order from the operation and the operator
5959 personally delivers the food to the consumer; and
6060 [(2)] subject to Subsection (c), before the operator
6161 accepts payment for the food, the operator provides all labeling
6262 information required by Section 437.0193(d) and department rules to
6363 the consumer by:
6464 (1) [(A)] posting a legible statement on the
6565 operation's Internet website;
6666 (2) [(B)] publishing the information in a catalog; or
6767 (3) [(C)] otherwise communicating the information to
6868 the consumer.
6969 SECTION 3. This Act takes effect September 1, 2023.
