55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain property located in a
88 reinvestment zone for certain ad valorem tax incentives.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 320, Tax Code, is amended by adding
1111 Section 320.002 to read as follows:
1212 Sec. 320.002. PROPERTY INELIGIBLE FOR TAX INCENTIVES. (a)
1313 In this section:
1414 (1) "Military aviation facility" has the meaning
1515 assigned by Section 312.0021.
1616 (2) "Qualifying property" means a parcel of land that
1717 is located wholly or partly in a reinvestment zone, a new building
1818 constructed on the parcel of land, a new improvement erected or
1919 affixed on the parcel of land, or tangible personal property placed
2020 in service in the building or improvement or on the parcel of land.
2121 (3) "Wind-powered energy device" has the meaning
2222 assigned by Section 11.27.
2323 (b) Notwithstanding any other law, an owner of qualifying
2424 property may not receive an exemption from ad valorem taxation or a
2525 limitation on appraised value for the qualifying property under an
2626 agreement entered into under a law enacted as part of a program to
2727 encourage economic development in an area designated as a
2828 reinvestment zone if, on or after the date the agreement is entered
2929 into, a wind-powered energy device is installed or constructed on
3030 the qualifying property at a location that is within 25 nautical
3131 miles of the boundaries of a military aviation facility located in
3232 this state. The prohibition provided by this subsection applies
3333 regardless of whether the wind-powered energy device is installed
3434 or constructed at a location that is in the reinvestment zone.
3535 SECTION 2. This Act applies only to ad valorem taxes imposed
3636 for a tax year beginning on or after the effective date of this Act.
3737 SECTION 3. To the extent of any conflict, this Act prevails
3838 over another Act of the 88th Legislature, Regular Session, 2023,
3939 regardless of the relative dates of enactment.
4040 SECTION 4. This Act takes effect January 1, 2024.
