| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 552.108, Government Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (d) to read as follows: |
|---|
| 10 | 10 | | (d) The exception to disclosure provided by Subsection |
|---|
| 11 | 11 | | (a)(2) does not apply to information, records, or notations if: |
|---|
| 12 | 12 | | (1) a person who is described by or depicted in the |
|---|
| 13 | 13 | | information, record, or notation, other than a peace officer, is |
|---|
| 14 | 14 | | deceased or incapacitated; or |
|---|
| 15 | 15 | | (2) each person who is described by or depicted in the |
|---|
| 16 | 16 | | information, record, or notation, other than a person who is |
|---|
| 17 | 17 | | deceased or incapacitated, consents to the release of the |
|---|
| 18 | 18 | | information, record, or notation. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 20 | | to a request for public information received by a governmental body |
|---|
| 21 | 21 | | or an officer for public information on or after the effective date |
|---|
| 22 | 22 | | of this Act. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
