44 AN ACT
55 relating to access to certain law enforcement, corrections, and
66 prosecutorial records under the public information law.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 552.108, Government Code, is amended by
99 adding Subsection (d) to read as follows:
1010 (d) The exception to disclosure provided by Subsection
1111 (a)(2) does not apply to information, records, or notations if:
1212 (1) a person who is described by or depicted in the
1313 information, record, or notation, other than a peace officer, is
1414 deceased or incapacitated; or
1515 (2) each person who is described by or depicted in the
1616 information, record, or notation, other than a person who is
1717 deceased or incapacitated, consents to the release of the
1818 information, record, or notation.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a request for public information received by a governmental body
2121 or an officer for public information on or after the effective date
2222 of this Act.
2323 SECTION 3. This Act takes effect September 1, 2023.
