55 relating to exempting certain contracts from procurement notice

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2262.051(j), Government Code, is amended
99 to read as follows:
1010 (j) For a procurement in an amount that exceeds $20 million
1111 [other than a contract entered into by the comptroller under
1212 Section 2155.061], the guide must require a state agency to notify
1313 interested parties at least two months before the date the agency
1414 issues the solicitation for the procurement unless the procurement
1515 is for:
1616 (1) a contract entered into by the comptroller under
1717 Section 2155.061; or
1818 (2) a contract for services necessary to respond to a
1919 natural disaster.
2020 SECTION 2. The changes in law made by this Act apply only to
2121 a contract for which a state agency first advertises or otherwise
2222 solicits bids, proposals, offers, or qualifications on or after the
2323 effective date of this Act. A contract for which a state agency
2424 first advertised or otherwise solicited bids, proposals, offers, or
2525 qualifications before that date is governed by the law in effect
2626 when the first advertisement or solicitation was given, and the
2727 former law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2023.
