| 5 | 5 | | relating to exempting certain contracts from procurement notice |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 2262.051(j), Government Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (j) For a procurement in an amount that exceeds $20 million |
|---|
| 11 | 11 | | [other than a contract entered into by the comptroller under |
|---|
| 12 | 12 | | Section 2155.061], the guide must require a state agency to notify |
|---|
| 13 | 13 | | interested parties at least two months before the date the agency |
|---|
| 14 | 14 | | issues the solicitation for the procurement unless the procurement |
|---|
| 15 | 15 | | is for: |
|---|
| 16 | 16 | | (1) a contract entered into by the comptroller under |
|---|
| 17 | 17 | | Section 2155.061; or |
|---|
| 18 | 18 | | (2) a contract for services necessary to respond to a |
|---|
| 19 | 19 | | natural disaster. |
|---|
| 20 | 20 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 21 | 21 | | a contract for which a state agency first advertises or otherwise |
|---|
| 22 | 22 | | solicits bids, proposals, offers, or qualifications on or after the |
|---|
| 23 | 23 | | effective date of this Act. A contract for which a state agency |
|---|
| 24 | 24 | | first advertised or otherwise solicited bids, proposals, offers, or |
|---|
| 25 | 25 | | qualifications before that date is governed by the law in effect |
|---|
| 26 | 26 | | when the first advertisement or solicitation was given, and the |
|---|
| 27 | 27 | | former law is continued in effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
