55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the amount of wine certain wineries may sell directly to
88 consumers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 16.01(a), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Section 16.011, the holder of a
1313 winery permit may:
1414 (1) manufacture, bottle, label, and package wine
1515 containing not more than 24 percent alcohol by volume;
1616 (2) manufacture fruit brandy and:
1717 (A) use that brandy on the winery permit holder's
1818 permitted premises for fortifying purposes only; or
1919 (B) sell that brandy to other winery permit
2020 holders;
2121 (3) import or buy fruit brandy from a permit holder
2222 authorized to manufacture fruit brandy and use that brandy on the
2323 winery permit holder's permitted premises for fortifying purposes
2424 only;
2525 (4) sell wine in this state to or buy wine from permit
2626 holders authorized to purchase and sell wine, including holders of
2727 wholesaler's permits and winery permits;
2828 (5) sell wine to ultimate consumers:
2929 (A) for consumption on the winery premises; or
3030 (B) in unbroken packages for off-premises
3131 consumption [in an amount not to exceed 35,000 gallons annually];
3232 (6) sell the wine outside this state to qualified
3333 persons;
3434 (7) blend wines;
3535 (8) dispense free wine for consumption on the winery
3636 premises; and
3737 (9) purchase and import wine from the holder of a
3838 nonresident seller's permit.
3939 SECTION 2. Section 54.02, Alcoholic Beverage Code, is
4040 amended to read as follows:
4141 Sec. 54.02. PROHIBITED ACTIVITIES. The holder of an
4242 out-of-state winery direct shipper's permit may not:
4343 (1) sell or ship wine to a minor;
4444 (2) deliver wine to a consumer using a carrier that
4545 does not hold a carrier's permit under this code; or
4646 (3) deliver to the same consumer in this state more
4747 than nine gallons of wine within any calendar month or more than 36
4848 gallons of wine within any 12-month period[; or
4949 [(4) sell to ultimate consumers more than 35,000
5050 gallons of wine annually].
5151 SECTION 3. This Act takes effect September 1, 2023.
