55 AN ACT
66 relating to references to "the people's money" in state documents,
77 publications, and notices.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 2051, Government Code, is amended by
1010 adding Subchapter G to read as follows:
1111 SUBCHAPTER G. STATE DOCUMENT REFERENCES TO THE PEOPLE'S MONEY
1212 Sec. 2051.251. REFERENCES TO THE PEOPLE'S MONEY. (a) A
1313 state official or state agency that, in an official document,
1414 publication, or notice published or issued in print or on a publicly
1515 accessible Internet web page, undertakes to refer to money held by
1616 this state, a state agency, or a state official that may be used
1717 only for a public purpose of this state may not refer to that money
1818 by a term or phrase other than the phrase "the people's money"
1919 except as provided by this section. The official or agency shall
2020 use the phrase "the people's money" instead of other common terms or
2121 phrases for money described by this subsection, including:
2222 (1) government funds;
2323 (2) government money;
2424 (3) public funds;
2525 (4) public money;
2626 (5) state funds; and
2727 (6) state money.
2828 (b) Subsection (a) does not apply to:
2929 (1) a state statute;
3030 (2) the Texas Constitution;
3131 (3) a document concerning, or a publication of, state
3232 agency rules that for reasons of legal clarity must rely on phrasing
3333 used in state statutes or the Texas Constitution; and
3434 (4) a reference to money this state holds in trust for
3535 the benefit of a person other than this state or a governmental
3636 entity of this state.
3737 SECTION 2. This Act takes effect September 1, 2023.
