| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 2051, Government Code, is amended by |
|---|
| 10 | 10 | | adding Subchapter G to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER G. STATE DOCUMENT REFERENCES TO THE PEOPLE'S MONEY |
|---|
| 12 | 12 | | Sec. 2051.251. REFERENCES TO THE PEOPLE'S MONEY. (a) A |
|---|
| 13 | 13 | | state official or state agency that, in an official document, |
|---|
| 14 | 14 | | publication, or notice published or issued in print or on a publicly |
|---|
| 15 | 15 | | accessible Internet web page, undertakes to refer to money held by |
|---|
| 16 | 16 | | this state, a state agency, or a state official that may be used |
|---|
| 17 | 17 | | only for a public purpose of this state may not refer to that money |
|---|
| 18 | 18 | | by a term or phrase other than the phrase "the people's money" |
|---|
| 19 | 19 | | except as provided by this section. The official or agency shall |
|---|
| 20 | 20 | | use the phrase "the people's money" instead of other common terms or |
|---|
| 21 | 21 | | phrases for money described by this subsection, including: |
|---|
| 22 | 22 | | (1) government funds; |
|---|
| 23 | 23 | | (2) government money; |
|---|
| 24 | 24 | | (3) public funds; |
|---|
| 25 | 25 | | (4) public money; |
|---|
| 26 | 26 | | (5) state funds; and |
|---|
| 27 | 27 | | (6) state money. |
|---|
| 28 | 28 | | (b) Subsection (a) does not apply to: |
|---|
| 29 | 29 | | (1) a state statute; |
|---|
| 30 | 30 | | (2) the Texas Constitution; |
|---|
| 31 | 31 | | (3) a document concerning, or a publication of, state |
|---|
| 32 | 32 | | agency rules that for reasons of legal clarity must rely on phrasing |
|---|
| 33 | 33 | | used in state statutes or the Texas Constitution; and |
|---|
| 34 | 34 | | (4) a reference to money this state holds in trust for |
|---|
| 35 | 35 | | the benefit of a person other than this state or a governmental |
|---|
| 36 | 36 | | entity of this state. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2023. |
