9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 455.059, Occupations Code, is amended to |
---|
11 | 11 | | read as follows: |

12 | 12 | | Sec. 455.059. INSPECTIONS; INVESTIGATIONS; DENIAL OF ENTRY |
---|
13 | 13 | | PROHIBITED. (a) The department, the department's authorized |
---|
14 | 14 | | representative, or a peace officer may enter the premises of a |
---|
15 | 15 | | massage establishment or massage school at: |
---|
16 | 16 | | (1) reasonable times to conduct an inspection |
---|
17 | 17 | | incidental to the issuance of a license; and |
---|
18 | 18 | | (2) other times that the department, the department's |
---|
19 | 19 | | authorized representative, or a peace officer considers necessary |
---|
20 | 20 | | to ensure compliance with this chapter and the rules adopted under |
---|
21 | 21 | | this chapter. |
---|
22 | 22 | | (b) A massage establishment or massage school may not deny |
---|
23 | 23 | | entry to the department, the department's authorized |
---|
24 | 24 | | representative, or a peace officer seeking to enter the premises |
---|
25 | 25 | | for a purpose and in a manner described by Subsection (a). |
---|
26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
