77 relating to entry into a massage establishment or massage school

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 455.059, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 455.059. INSPECTIONS; INVESTIGATIONS; DENIAL OF ENTRY
1313 PROHIBITED. (a) The department, the department's authorized
1414 representative, or a peace officer may enter the premises of a
1515 massage establishment or massage school at:
1616 (1) reasonable times to conduct an inspection
1717 incidental to the issuance of a license; and
1818 (2) other times that the department, the department's
1919 authorized representative, or a peace officer considers necessary
2020 to ensure compliance with this chapter and the rules adopted under
2121 this chapter.
2222 (b) A massage establishment or massage school may not deny
2323 entry to the department, the department's authorized
2424 representative, or a peace officer seeking to enter the premises
2525 for a purpose and in a manner described by Subsection (a).
2626 SECTION 2. This Act takes effect September 1, 2023.
