55 relating to the prosecution of the criminal offenses of aggravated
66 kidnapping, kidnapping, and interference with child custody.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. This Act may be cited as Bianca's Law.
99 SECTION 2. Article 12.01, Code of Criminal Procedure, is
1010 amended to read as follows:
1111 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1212 felony indictments may be presented within these limits, and not
1313 afterward:
1414 (1) no limitation:
1515 (A) murder and manslaughter;
1616 (B) sexual assault under Section 22.011(a)(2),
1717 Penal Code, or aggravated sexual assault under Section
1818 22.021(a)(1)(B), Penal Code;
1919 (C) sexual assault, if:
2020 (i) during the investigation of the offense
2121 biological matter is collected and the matter:
2222 (a) has not yet been subjected to
2323 forensic DNA testing; or
2424 (b) has been subjected to forensic DNA
2525 testing and the testing results show that the matter does not match
2626 the victim or any other person whose identity is readily
2727 ascertained; or
2828 (ii) probable cause exists to believe that
2929 the defendant has committed the same or a similar sex offense
3030 against five or more victims;
3131 (D) continuous sexual abuse of young child or
3232 disabled individual under Section 21.02, Penal Code;
3333 (E) indecency with a child under Section 21.11,
3434 Penal Code;
3535 (F) an offense involving leaving the scene of an
3636 accident under Section 550.021, Transportation Code, if the
3737 accident resulted in the death of a person;
3838 (G) trafficking of persons under Section
3939 20A.02(a)(7) or (8), Penal Code;
4040 (H) continuous trafficking of persons under
4141 Section 20A.03, Penal Code; [or]
4242 (I) compelling prostitution under Section
4343 43.05(a)(2), Penal Code; or
4444 (J) interference with child custody under
4545 Section 25.03(a)(3), Penal Code;
4646 (2) ten years from the date of the commission of the
4747 offense:
4848 (A) theft of any estate, real, personal or mixed,
4949 by an executor, administrator, guardian or trustee, with intent to
5050 defraud any creditor, heir, legatee, ward, distributee,
5151 beneficiary or settlor of a trust interested in such estate;
5252 (B) theft by a public servant of government
5353 property over which the public servant exercises control in the
5454 public servant's official capacity;
5555 (C) forgery or the uttering, using, or passing of
5656 forged instruments;
5757 (D) injury to an elderly or disabled individual
5858 punishable as a felony of the first degree under Section 22.04,
5959 Penal Code;
6060 (E) sexual assault, except as provided by
6161 Subdivision (1) or (7);
6262 (F) arson;
6363 (G) trafficking of persons under Section
6464 20A.02(a)(1), (2), (3), or (4), Penal Code; or
6565 (H) compelling prostitution under Section
6666 43.05(a)(1), Penal Code;
6767 (3) seven years from the date of the commission of the
6868 offense:
6969 (A) misapplication of fiduciary property or
7070 property of a financial institution;
7171 (B) fraudulent securing of document execution;
7272 (C) a felony violation under Chapter 162, Tax
7373 Code;
7474 (D) false statement to obtain property or credit
7575 under Section 32.32, Penal Code;
7676 (E) money laundering;
7777 (F) credit card or debit card abuse under Section
7878 32.31, Penal Code;
7979 (G) fraudulent use or possession of identifying
8080 information under Section 32.51, Penal Code;
8181 (H) exploitation of a child, elderly individual,
8282 or disabled individual under Section 32.53, Penal Code;
8383 (I) health care fraud under Section 35A.02, Penal
8484 Code; or
8585 (J) bigamy under Section 25.01, Penal Code,
8686 except as provided by Subdivision (6);
8787 (4) five years from the date of the commission of the
8888 offense:
8989 (A) theft or robbery;
9090 (B) except as provided by Subdivision (5),
9191 kidnapping or burglary;
9292 (C) injury to an elderly or disabled individual
9393 that is not punishable as a felony of the first degree under Section
9494 22.04, Penal Code;
9595 (D) abandoning or endangering a child; or
9696 (E) insurance fraud;
9797 (5) if the investigation of the offense shows that the
9898 victim is younger than 17 years of age at the time the offense is
9999 committed, 20 years from the 18th birthday of the victim of one of
100100 the following offenses:
101101 (A) sexual performance by a child under Section
102102 43.25, Penal Code;
103103 (B) kidnapping under Section 20.03, Penal Code,
104104 or aggravated kidnapping under Section 20.04 [20.04(a)(4)], Penal
105105 Code[, if the defendant committed the offense with the intent to
106106 violate or abuse the victim sexually]; or
107107 (C) burglary under Section 30.02, Penal Code, if
108108 the offense is punishable under Subsection (d) of that section and
109109 the defendant committed the offense with the intent to commit an
110110 offense described by Subdivision (1)(B) or (D) of this article or
111111 Paragraph (B) of this subdivision;
112112 (6) ten years from the 18th birthday of the victim of
113113 the offense:
114114 (A) trafficking of persons under Section
115115 20A.02(a)(5) or (6), Penal Code;
116116 (B) injury to a child under Section 22.04, Penal
117117 Code; or
118118 (C) bigamy under Section 25.01, Penal Code, if
119119 the investigation of the offense shows that the person, other than
120120 the legal spouse of the defendant, whom the defendant marries or
121121 purports to marry or with whom the defendant lives under the
122122 appearance of being married is younger than 18 years of age at the
123123 time the offense is committed;
124124 (7) two years from the date the offense was
125125 discovered: sexual assault punishable as a state jail felony under
126126 Section 22.011(f)(2), Penal Code; or
127127 (8) three years from the date of the commission of the
128128 offense: all other felonies.
129129 SECTION 3. Section 25.03, Penal Code, is amended by adding
130130 Subsection (e) to read as follows:
131131 (e) If conduct that constitutes an offense under Subsection
132132 (a)(3) also constitutes an offense under Section 20.03, the actor
133133 may be prosecuted only under Section 20.03.
134134 SECTION 4. Article 12.01, Code of Criminal Procedure, as
135135 amended by this Act, does not apply to the prosecution of an offense
136136 if that prosecution becomes barred by limitation before the
137137 effective date of this Act. The prosecution of the offense remains
138138 barred as if this Act had not taken effect.
139139 SECTION 5. Section 25.03(e), Penal Code, as added by this
140140 Act, applies only to an offense committed on or after the effective
141141 date of this Act. An offense committed before the effective date of
142142 this Act is governed by the law in effect on the date the offense was
143143 committed, and the former law is continued in effect for that
144144 purpose. For purposes of this section, an offense was committed
145145 before the effective date of this Act if any element of the offense
146146 occurred before that date.
147147 SECTION 6. This Act takes effect September 1, 2023.
