| 7 | 7 | | relating to the practice of cosmetology by an eyelash specialist |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1603.0011(c), Occupations Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) In addition to the services described by Subsection (a), |
|---|
| 13 | 13 | | the practice of cosmetology includes: |
|---|
| 14 | 14 | | (1) performing or offering to perform for compensation |
|---|
| 15 | 15 | | the service of applying semipermanent, thread-like extensions |
|---|
| 16 | 16 | | composed of single fibers to a person's eyelashes; and |
|---|
| 17 | 17 | | (2) altering the shape or color of a person's eyelashes |
|---|
| 18 | 18 | | using a cosmetic preparation or appliance. |
|---|
| 19 | 19 | | SECTION 2. Section 1603.2103(a), Occupations Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | (a) A person holding: |
|---|
| 22 | 22 | | (1) a Class A barber license may perform any barbering |
|---|
| 23 | 23 | | service; |
|---|
| 24 | 24 | | (2) a cosmetology operator license may perform any |
|---|
| 25 | 25 | | cosmetology service; |
|---|
| 26 | 26 | | (3) a manicurist license may perform any service |
|---|
| 27 | 27 | | described by Section 1603.0011(a)(7) or (8); |
|---|
| 28 | 28 | | (4) an esthetician license may perform any service |
|---|
| 29 | 29 | | described by Section 1603.0011(a)(3), (4), (5), or (6) or (c); |
|---|
| 30 | 30 | | (5) a manicurist/esthetician license may perform any |
|---|
| 31 | 31 | | service described by Section 1603.0011(a)(3), (4), (5), (6), (7), |
|---|
| 32 | 32 | | or (8) or (c); |
|---|
| 33 | 33 | | (6) a hair weaving specialist license may perform any |
|---|
| 34 | 34 | | service described by Section 1603.0011(a)(9); |
|---|
| 35 | 35 | | (7) a hair weaving specialist/esthetician license may |
|---|
| 36 | 36 | | perform any service described by Section 1603.0011(a)(3), (4), (5), |
|---|
| 37 | 37 | | (6), or (9) or (c); and |
|---|
| 38 | 38 | | (8) an eyelash [extension] specialist license may |
|---|
| 39 | 39 | | perform any service described by Section 1603.0011(c). |

| 40 | 40 | | SECTION 3. Section 1603.2203(a), Occupations Code, is |
|---|
| 41 | 41 | | amended to read as follows: |
|---|
| 42 | 42 | | (a) An establishment licensed as: |
|---|
| 43 | 43 | | (1) an establishment may provide any barbering or |
|---|
| 44 | 44 | | cosmetology service; |
|---|
| 45 | 45 | | (2) a manicurist specialty establishment may provide |
|---|
| 46 | 46 | | any service described by Section 1603.0011(a)(7) or (8); |
|---|
| 47 | 47 | | (3) an esthetician specialty establishment may |
|---|
| 48 | 48 | | provide any service described by Section 1603.0011(a)(3), (4), (5), |
|---|
| 49 | 49 | | or (6) or (c); |
|---|
| 50 | 50 | | (4) a manicurist/esthetician specialty establishment |
|---|
| 51 | 51 | | may provide any service described by Section 1603.0011(a)(3), (4), |
|---|
| 52 | 52 | | (5), (6), (7), or (8) or (c); |
|---|
| 53 | 53 | | (5) a hair weaving specialty establishment may provide |
|---|
| 54 | 54 | | any service described by Section 1603.0011(a)(9); |
|---|
| 55 | 55 | | (6) an eyelash [extension] specialty establishment |
|---|
| 56 | 56 | | may provide any service described by Section 1603.0011(c); |
|---|
| 57 | 57 | | (7) a mini-establishment may provide any barbering or |
|---|
| 58 | 58 | | cosmetology service; and |
|---|
| 59 | 59 | | (8) a mobile establishment may provide any barbering |
|---|
| 60 | 60 | | or cosmetology service. |
|---|
| 61 | 61 | | SECTION 4. This Act takes effect September 1, 2023. |
