77 relating to required verification of the employment history of
88 certain job applicants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 3, Labor Code, is amended by adding Chapter
1111 106 to read as follows:
1212 CHAPTER 106. EMPLOYER HIRING PRACTICES
1313 Sec. 106.001. DEFINITIONS. In this chapter:
1414 (1) "Applicant" means an individual who has made an
1515 oral or written application with an employer, or has sent a resume
1616 or other correspondence to an employer, indicating an interest in
1717 employment.
1818 (2) "Employer" means a person who employs one or more
1919 employees.
2020 Sec. 106.002. REQUIRED VERIFICATION OF EMPLOYMENT HISTORY
2121 FOR CERTAIN POSITIONS. If the job duties of the position for which
2222 an applicant is applying require or may require entry into a
2323 person's residence, the prospective employer shall verify the
2424 applicant's employment history before extending an offer of
2525 employment for that position.
2626 Sec. 106.003. LIABILITY OF EMPLOYER. An employer is liable
2727 in a civil action for personal injury, death, or any other damages:
2828 (1) caused by an employee who was extended an offer of
2929 employment in violation of Section 106.002; and
3030 (2) that occurred in connection with the employee
3131 entering the residence of a person in the course of employment.
3232 SECTION 2. Section 106.002, Labor Code, as added by this
3333 Act, applies only to an offer of employment made on or after the
3434 effective date of this Act.
3535 SECTION 3. Section 106.003, Labor Code, as added by this
3636 Act, applies only to a cause of action that accrues on or after the
3737 effective date of this Act.
3838 SECTION 4. This Act takes effect September 1, 2023.
