9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Title 3, Labor Code, is amended by adding Chapter |
---|
11 | 11 | | 106 to read as follows: |
---|
12 | 12 | | CHAPTER 106. EMPLOYER HIRING PRACTICES |
---|
13 | 13 | | Sec. 106.001. DEFINITIONS. In this chapter: |
---|
14 | 14 | | (1) "Applicant" means an individual who has made an |
---|
15 | 15 | | oral or written application with an employer, or has sent a resume |
---|
16 | 16 | | or other correspondence to an employer, indicating an interest in |
---|
17 | 17 | | employment. |
---|
18 | 18 | | (2) "Employer" means a person who employs one or more |
---|
19 | 19 | | employees. |
---|
20 | 20 | | Sec. 106.002. REQUIRED VERIFICATION OF EMPLOYMENT HISTORY |
---|
21 | 21 | | FOR CERTAIN POSITIONS. If the job duties of the position for which |
---|
22 | 22 | | an applicant is applying require or may require entry into a |
---|
23 | 23 | | person's residence, the prospective employer shall verify the |
---|
24 | 24 | | applicant's employment history before extending an offer of |
---|
25 | 25 | | employment for that position. |
---|
26 | 26 | | Sec. 106.003. LIABILITY OF EMPLOYER. An employer is liable |
---|
27 | 27 | | in a civil action for personal injury, death, or any other damages: |
---|
28 | 28 | | (1) caused by an employee who was extended an offer of |
---|
29 | 29 | | employment in violation of Section 106.002; and |
---|
30 | 30 | | (2) that occurred in connection with the employee |
---|
31 | 31 | | entering the residence of a person in the course of employment. |
---|
32 | 32 | | SECTION 2. Section 106.002, Labor Code, as added by this |
---|
33 | 33 | | Act, applies only to an offer of employment made on or after the |
---|
34 | 34 | | effective date of this Act. |
---|
35 | 35 | | SECTION 3. Section 106.003, Labor Code, as added by this |
---|
36 | 36 | | Act, applies only to a cause of action that accrues on or after the |
---|
37 | 37 | | effective date of this Act. |
---|
38 | 38 | | SECTION 4. This Act takes effect September 1, 2023. |
