66 AN ACT
77 relating to notice regarding nonemergency ambulance and certain
88 nonemergency health care coverage in health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1210, Insurance Code, is amended to read
1111 as follows:
1212 CHAPTER 1210. NOTICE OF CERTAIN POLICY PROVISIONS
1313 SUBCHAPTER A. NOTICE OF PROVISIONS RELATED TO RENEWAL OR NONRENEWAL
1414 Sec. 1210.001. NOTICE REQUIRED. A policy, contract, or
1515 certificate of insurance that insures against loss resulting from
1616 sickness or accidental bodily injury and that is subject to an
1717 increase in the premium at time of renewal or to nonrenewal on the
1818 insured attaining a certain age may not be delivered, issued, or
1919 used in this state unless the document contains on the first page
2020 above the policy provisions a printed notice in 10-point type that
2121 states that the policy, contract, or certificate is subject to
2222 either or both conditions.
2323 SUBCHAPTER B. AMBULANCE AND CERTAIN NONEMERGENCY HEALTH CARE
2424 COVERAGE PROVISIONS
2525 Sec. 1210.011. DEFINITION. In this subchapter, "emergency
2626 medical services personnel" has the meaning assigned by Section
2727 773.003, Health and Safety Code.
2828 Sec. 1210.012. APPLICABILITY OF SUBCHAPTER. (a) This
2929 subchapter applies only to a health benefit plan that provides
3030 benefits for medical or surgical expenses incurred as a result of a
3131 health condition, accident, or sickness, including an individual,
3232 group, blanket, or franchise insurance policy or insurance
3333 agreement, a group hospital service contract, or an individual or
3434 group evidence of coverage or similar coverage document that is
3535 offered by:
3636 (1) an insurance company;
3737 (2) a group hospital service corporation operating
3838 under Chapter 842;
3939 (3) a health maintenance organization operating under
4040 Chapter 843;
4141 (4) an approved nonprofit health corporation
4242 that holds a certificate of authority under Chapter 844;
4343 (5) a multiple employer welfare arrangement that holds
4444 a certificate of authority under Chapter 846;
4545 (6) a stipulated premium company operating under
4646 Chapter 884;
4747 (7) a fraternal benefit society operating under
4848 Chapter 885;
4949 (8) a Lloyd's plan operating under Chapter 941; or
5050 (9) an exchange operating under Chapter 942.
5151 (b) Notwithstanding any other law, this subchapter applies
5252 to:
5353 (1) a small employer health benefit plan subject to
5454 Chapter 1501, including coverage provided through a health group
5555 cooperative under Subchapter B of that chapter;
5656 (2) a standard health benefit plan issued under
5757 Chapter 1507;
5858 (3) a basic coverage plan under Chapter 1551;
5959 (4) a basic plan under Chapter 1575;
6060 (5) a primary care coverage plan under Chapter 1579;
6161 (6) a plan providing basic coverage under Chapter
6262 1601;
6363 (7) nonprofit agricultural organization health
6464 benefits offered by a nonprofit agricultural organization under
6565 Chapter 1682;
6666 (8) alternative health benefit coverage offered by a
6767 subsidiary of the Texas Mutual Insurance Company under Subchapter
6868 M, Chapter 2054;
6969 (9) health benefits provided by or through a church
7070 benefits board under Subchapter I, Chapter 22, Business
7171 Organizations Code;
7272 (10) the state Medicaid program, including the
7373 Medicaid managed care program operated under Chapter 533,
7474 Government Code;
7575 (11) the child health plan program under Chapter 62,
7676 Health and Safety Code;
7777 (12) a regional or local health care program operated
7878 under Section 75.104, Health and Safety Code;
7979 (13) a self-funded health benefit plan sponsored by a
8080 professional employer organization under Chapter 91, Labor Code;
8181 (14) county employee group health benefits provided
8282 under Chapter 157, Local Government Code; and
8383 (15) health and accident coverage provided by a risk
8484 pool created under Chapter 172, Local Government Code.
8585 Sec. 1210.013. NOTICE REQUIRED. (a) This section applies
8686 only with respect to a health benefit plan that does not provide
8787 coverage for nonemergency ambulance services or nonemergency
8888 health care services provided by emergency medical services
8989 personnel.
9090 (b) A health benefit plan issuer or administrator shall
9191 provide written notice in the form and manner prescribed by the
9292 commissioner in an explanation of benefits provided to an enrollee
9393 that the enrollee's plan does not cover nonemergency ambulance
9494 services or nonemergency health care services provided by emergency
9595 medical services personnel.
9696 SECTION 2. If before implementing any provision of this Act
9797 a state agency determines that a waiver or authorization from a
9898 federal agency is necessary for implementation of that provision,
9999 the agency affected by the provision shall request the waiver or
100100 authorization and may delay implementing the provision until the
101101 waiver or authorization is granted.
102102 SECTION 3. This Act takes effect September 1, 2023.
