55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Public Utility Commission of Texas
88 regarding grid resilience and emergency response in electric power
99 generation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITION. In this Act, "commission" means the
1212 Public Utility Commission of Texas.
1313 SECTION 2. GRID RESILIENCE AND EMERGENCY RESPONSE STUDY.
1414 (a) The commission shall conduct a study on electric grid
1515 resilience and emergency response in electric power generation.
1616 (b) The study conducted under this section must include:
1717 (1) an analysis of:
1818 (A) technologies, methods, and concepts that may
1919 improve community resilience to frequent or long-duration power
2020 outages;
2121 (B) upgrades and improvements to grid
2222 infrastructure to accommodate projected changes in power demand;
2323 and
2424 (C) previous long-duration power outages that
2525 occurred over a large area to identify common elements and best
2626 practices for electricity restoration and the mitigation and
2727 prevention of future outages; and
2828 (2) the development of:
2929 (A) methods to improve government and community
3030 preparation for long-duration power outages and power outages that
3131 occur over a large area;
3232 (B) tools to help electric utilities ensure
3333 continuous delivery of electricity to emergency facilities;
3434 (C) tools to improve coordination between the
3535 independent organization certified under Section 39.151, Utilities
3636 Code, for the ERCOT power region, entities that distribute electric
3737 energy, and political subdivisions;
3838 (D) technologies and capabilities to withstand
3939 and address the current and predicted effect of extreme weather
4040 events and other natural disasters, including the effect of the
4141 changing climate on electric grid infrastructure;
4242 (E) methods to improve information sharing
4343 between relevant federal and state agencies in the event of a mass
4444 power outage, or a physical or cyber attack on electric
4545 infrastructure;
4646 (F) advance monitoring, analytics, operation,
4747 and controls of electric grid systems to improve electric grid
4848 resilience;
4949 (G) methods to maintain cybersecurity during
5050 restoration of electric grid infrastructure and operation; and
5151 (H) methods to strengthen against or otherwise
5252 mitigate adverse effects on electric grid infrastructure from
5353 natural hazards.
5454 (c) In conducting the study, the commission may collaborate
5555 with other state agencies, institutions of higher education,
5656 nonprofit corporations, electric utilities, and other interested
5757 persons.
5858 SECTION 3. REPORT. Not later than September 1, 2024, the
5959 commission shall report the results of the study conducted under
6060 this Act and any recommendations to the legislature. The report
6161 must include any statutory changes necessary to implement the
6262 recommendations made in the report.
6363 SECTION 4. DEMONSTRATION PROJECTS. The commission may
6464 initiate a demonstration project to prove the effectiveness of a
6565 concept, technology, strategy, practice, or method related to any
6666 topic of the study conducted under this Act.
6767 SECTION 5. EXPIRATION. This Act expires December 31, 2024.
6868 SECTION 6. EFFECTIVE DATE. This Act takes effect September
6969 1, 2023.
