10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter E, Chapter 801, Occupations Code, is |
---|
12 | 12 | | amended by adding Section 801.2052 to read as follows: |

13 | 13 | | Sec. 801.2052. DISMISSAL OF BASELESS OR UNFOUNDED |
---|
14 | 14 | | COMPLAINT. (a) If the board determines that a complaint filed with |
---|
15 | 15 | | the board is baseless or unfounded, the board shall: |
---|
16 | 16 | | (1) dismiss the complaint; and |
---|
17 | 17 | | (2) include a statement in the record of the complaint |
---|
18 | 18 | | that the complaint was dismissed because the complaint was baseless |
---|
19 | 19 | | or unfounded. |
---|
20 | 20 | | (b) The board shall adopt rules that establish criteria for |
---|
21 | 21 | | determining that a complaint is baseless or unfounded. |
---|
22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
