77 AN ACT
88 relating to the dismissal of a baseless or unfounded complaint
99 filed with the State Board of Veterinary Medical Examiners.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter E, Chapter 801, Occupations Code, is
1212 amended by adding Section 801.2052 to read as follows:
1313 Sec. 801.2052. DISMISSAL OF BASELESS OR UNFOUNDED
1414 COMPLAINT. (a) If the board determines that a complaint filed with
1515 the board is baseless or unfounded, the board shall:
1616 (1) dismiss the complaint; and
1717 (2) include a statement in the record of the complaint
1818 that the complaint was dismissed because the complaint was baseless
1919 or unfounded.
2020 (b) The board shall adopt rules that establish criteria for
2121 determining that a complaint is baseless or unfounded.
2222 SECTION 2. This Act takes effect September 1, 2023.
