44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the publication of a line-item budget by school
77 districts and municipalities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 44.0041, Education Code, is amended to
1010 read as follows:
1111 Sec. 44.0041. PUBLICATION OF LINE-ITEM [SUMMARY OF
1212 PROPOSED] BUDGET. [(a)] Concurrently with the publication of
1313 notice of the budget under Section 44.004, a school district shall
1414 post the district's proposed budget in line-item form [a summary of
1515 the proposed budget]:
1616 (1) on the school district's Internet website; or
1717 (2) if the district has no Internet website, in the
1818 district's central administrative office.
1919 [(b) The budget summary must include:
2020 [(1) information relating to per student and aggregate
2121 spending on:
2222 [(A) instruction;
2323 [(B) instructional support;
2424 [(C) central administration;
2525 [(D) district operations;
2626 [(E) debt service; and
2727 [(F) any other category designated by the
2828 commissioner; and
2929 [(2) a comparison to the previous year's actual
3030 spending.]
3131 SECTION 2. Section 44.0041, Education Code, is amended to
3232 read as follows:
3333 Sec. 44.0051. POSTING OF ADOPTED BUDGET. (a) On final
3434 approval of the budget by the board of trustees, the school district
3535 shall post on the district's Internet website a copy of the budget,
3636 in line-item form, adopted by the board of trustees. The district's
3737 Internet website must prominently display the electronic link to
3838 the adopted budget, in line-item form.
3939 (b) The district shall maintain the adopted budget, in
4040 line-item form, on the district's Internet website until the third
4141 anniversary of the date the budget was adopted.
4242 SECTION 3. Section 102.005, Local Government Code, is
4343 amended to read as follows:
4444 Sec. 102.005. PROPOSED BUDGET FILED WITH MUNICIPAL CLERK;
4545 PUBLIC INSPECTION. (a) The budget officer shall file the proposed
4646 budget with the municipal clerk before the 30th day before the date
4747 the governing body of the municipality makes its tax levy for the
4848 fiscal year.
4949 (b) A proposed budget that will require raising more revenue
5050 from property taxes than in the previous year must contain a cover
5151 page with the following statement in 18-point or larger type: "This
5252 budget will raise more total property taxes than last year's budget
5353 by (insert total dollar amount of increase and percentage
5454 increase), and of that amount (insert amount computed by
5555 multiplying the proposed tax rate by the value of new property added
5656 to the roll) is tax revenue to be raised from new property added to
5757 the tax roll this year."
5858 (c) The proposed budget, in line-item form, shall be
5959 available for inspection by any person. If the municipality
6060 maintains an Internet website, the municipal clerk shall take
6161 action to ensure that the proposed budget, in line-item form, is
6262 posted on the website.
6363 SECTION 4. Section 102.008, Local Government Code, is
6464 amended to read as follows:
6565 Sec. 102.008. APPROVED BUDGET FILED WITH MUNICIPAL CLERK:
6666 POSTING ON INTERNET. (a) On final approval of the budget by the
6767 governing body of the municipality, the governing body shall:
6868 (1) file the budget with the municipal clerk; and
6969 (2) if the municipality maintains an Internet website,
7070 take action to ensure that:
7171 (A) a copy of the budget, in line-item form,
7272 including the cover page, is posted on the website; and
7373 (B) the record vote described by Section
7474 102.007(d)(2) is posted on the website at least until the first
7575 anniversary of the date the budget is adopted.
7676 SECTION 5. This Act takes effect September 1, 2023.
