6	6	relating to the publication of a line-item budget by school
7	7	districts and municipalities.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 44.0041, Education Code, is amended to
10	10	read as follows:
11	11	Sec. 44.0041. PUBLICATION OF LINE-ITEM [SUMMARY OF
12	12	PROPOSED] BUDGET. [(a)] Concurrently with the publication of
13	13	notice of the budget under Section 44.004, a school district shall
14	14	post the district's proposed budget in line-item form [a summary of
15	15	the proposed budget]:
16	16	(1) on the school district's Internet website; or
17	17	(2) if the district has no Internet website, in the
18	18	district's central administrative office.
19	19	[(b) The budget summary must include:
20	20	[(1) information relating to per student and aggregate
21	21	spending on:
22	22	[(A) instruction;
23	23	[(B) instructional support;
24	24	[(C) central administration;
25	25	[(D) district operations;
26	26	[(E) debt service; and
27	27	[(F) any other category designated by the
28	28	commissioner; and
29	29	[(2) a comparison to the previous year's actual
30	30	spending.]
31	31	SECTION 2. Section 44.0041, Education Code, is amended to
32	32	read as follows:
33	33	Sec. 44.0051. POSTING OF ADOPTED BUDGET. (a) On final
34	34	approval of the budget by the board of trustees, the school district
35	35	shall post on the district's Internet website a copy of the budget,
36	36	in line-item form, adopted by the board of trustees. The district's
37	37	Internet website must prominently display the electronic link to
38	38	the adopted budget, in line-item form.
39	39	(b) The district shall maintain the adopted budget, in
40	40	line-item form, on the district's Internet website until the third
41	41	anniversary of the date the budget was adopted.
42	42	SECTION 3. Section 102.005, Local Government Code, is
43	43	amended to read as follows:
44	44	Sec. 102.005. PROPOSED BUDGET FILED WITH MUNICIPAL CLERK;
45	45	PUBLIC INSPECTION. (a) The budget officer shall file the proposed
46	46	budget with the municipal clerk before the 30th day before the date
47	47	the governing body of the municipality makes its tax levy for the
48	48	fiscal year.
49	49	(b) A proposed budget that will require raising more revenue
50	50	from property taxes than in the previous year must contain a cover
51	51	page with the following statement in 18-point or larger type: "This
52	52	budget will raise more total property taxes than last year's budget
53	53	by (insert total dollar amount of increase and percentage
54	54	increase), and of that amount (insert amount computed by
55	55	multiplying the proposed tax rate by the value of new property added
56	56	to the roll) is tax revenue to be raised from new property added to
57	57	the tax roll this year."
58	58	(c) The proposed budget, in line-item form, shall be
59	59	available for inspection by any person. If the municipality
60	60	maintains an Internet website, the municipal clerk shall take
61	61	action to ensure that the proposed budget, in line-item form, is
62	62	posted on the website.
63	63	SECTION 4. Section 102.008, Local Government Code, is
64	64	amended to read as follows:
65	65	Sec. 102.008. APPROVED BUDGET FILED WITH MUNICIPAL CLERK:
66	66	POSTING ON INTERNET. (a) On final approval of the budget by the
67	67	governing body of the municipality, the governing body shall:
68	68	(1) file the budget with the municipal clerk; and
69	69	(2) if the municipality maintains an Internet website,
70	70	take action to ensure that:
71	71	(A) a copy of the budget, in line-item form,
72	72	including the cover page, is posted on the website; and
73	73	(B) the record vote described by Section
74	74	102.007(d)(2) is posted on the website at least until the first
75	75	anniversary of the date the budget is adopted.
76	76	SECTION 5. This Act takes effect September 1, 2023.
