55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of certain energy efficiency programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 388, Health and Safety Code, is amended
1010 by designating Sections 388.001 through 388.012 as Subchapter A and
1111 adding a subchapter heading to read as follows:

1313 SECTION 2. Chapter 388, Health and Safety Code, is amended
1414 by adding Subchapter B to read as follows:
1515 SUBCHAPTER B. ENERGY EFFICIENCY PROGRAMS
1616 Sec. 388.051. ENERGY EFFICIENCY LOAN GUARANTEE PROGRAM.
1717 (a) The comptroller and the State Energy Conservation Office by
1818 rule shall establish and administer a program to issue or guarantee
1919 loans for energy audits, upgrades, or retrofits to increase the
2020 energy efficiency of commercial buildings and residences that are
2121 not newly constructed.
2222 (b) Rules adopted under this section must establish
2323 eligibility requirements to receive a loan or loan guarantee under
2424 this section. The requirements must include emissions reduction
2525 cost-effectiveness criteria.
2626 (c) The State Energy Conservation Office shall:
2727 (1) use money from federal grants available through
2828 the United States Department of Energy to begin the program
2929 established under this section and leverage private capital or
3030 state resources, if money available under the grants is
3131 appropriated for that purpose; and
3232 (2) establish policies for the use of federal grants
3333 that are compatible with requirements associated with the issuance
3434 of those grants.
3535 (d) The State Energy Conservation Office may use a portion
3636 of the money or other resources described by Subsection (c) for
3737 grants, technical assistance, or administrative expenses.
3838 Sec. 388.052. HOME REBATE PROGRAM. (a) The comptroller and
3939 the State Energy Conservation Office shall establish a home rebate
4040 program for whole-house energy savings retrofit programs that will
4141 make rebates available to eligible third-party aggregators and
4242 households, including single-family and multifamily residences, to
4343 make existing residences more energy efficient.
4444 (b) The State Energy Conservation Office shall establish
4545 program requirements that are compatible with federal standards and
4646 beneficial to the state.
4747 (c) The State Energy Conservation Office may use money
4848 available to the office for purposes of this section for grants,
4949 technical assistance, and administrative expenses, including
5050 appropriate contracts.
5151 (d) The State Energy Conservation Office may coordinate
5252 with the Public Utility Commission of Texas and electric utility
5353 providers, including electric cooperatives and municipally owned
5454 utilities, to maximize the benefits of the program established
5555 under this section by combining the benefits of the program with
5656 other programs.
5757 Sec. 388.053. HIGH-EFFICIENCY ELECTRIC HOME REBATE
5858 PROGRAM. (a) The comptroller and the State Energy Conservation
5959 Office shall establish a high-efficiency electric home rebate
6060 program for electric appliances that have an overall energy benefit
6161 to the state when installed in households, including single-family
6262 and multifamily residences.
6363 (b) The State Energy Conservation Office shall establish
6464 program requirements that are compatible with federal standards and
6565 beneficial to the state.
6666 (c) The State Energy Conservation Office may use money
6767 available to the office for purposes of this section for grants,
6868 technical assistance, and administrative expenses, including
6969 appropriate contracts.
7070 Sec. 388.054. IMPLEMENTATION PROGRAM. (a) The comptroller
7171 and the State Energy Conservation Office shall establish a program
7272 to foster sustained, cost-effective implementation of
7373 international codes, including the International Energy
7474 Conservation Code and its subsequent revisions, to the extent
7575 allowed by state law. The program must provide for training,
7676 grants, and other assistance as necessary.
7777 (b) The State Energy Conservation Office shall establish
7878 program requirements that are compatible with federal standards and
7979 beneficial to the state.
8080 (c) The State Energy Conservation Office may use money
8181 available to the office for purposes of this section for grants,
8282 technical assistance, and administrative expenses.
8383 Sec. 388.055. REQUIRED REPORTS. The State Energy
8484 Conservation Office annually shall submit to the commission and the
8585 laboratory a report that:
8686 (1) evaluates the effectiveness of the programs
8787 established under this subchapter; and
8888 (2) quantifies energy savings and emissions
8989 reductions as a result of programs established under this
9090 subchapter for consideration in the state implementation plan for
9191 emissions reduction credit.
9292 Sec. 388.056. EXPIRATION. This subchapter expires December
9393 31, 2031.
9494 SECTION 3. Section 389.002, Health and Safety Code, is
9595 amended to read as follows:
9696 Sec. 389.002. USE OF CERTAIN INFORMATION FOR FEDERAL
9797 RECOGNITION OF EMISSIONS REDUCTIONS. The commission, using
9898 information derived from the reports to the commission under
9999 Sections 386.205, 388.003(e), [and] 388.006, and 388.055, shall
100100 take all appropriate and necessary actions so that emissions
101101 reductions achieved by means of activities under Chapters 386 and
102102 388 are credited by the United States Environmental Protection
103103 Agency to the appropriate emissions reduction objectives in the
104104 state implementation plan.
105105 SECTION 4. This Act takes effect September 1, 2023.
