55 AN ACT
66 relating to the punishment for the offense of aggravated assault.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 22.02(b), Penal Code, is amended to read
99 as follows:
1010 (b) An offense under this section is a felony of the second
1111 degree, except that the offense is a felony of the first degree if:
1212 (1) the actor uses a deadly weapon during the
1313 commission of the assault and causes serious bodily injury to a
1414 person whose relationship to or association with the defendant is
1515 described by Section 71.0021(b), 71.003, or 71.005, Family Code;
1616 (2) regardless of whether the offense is committed
1717 under Subsection (a)(1) or (a)(2), the offense is committed:
1818 (A) by a public servant acting under color of the
1919 servant's office or employment;
2020 (B) against a person the actor knows is a public
2121 servant while the public servant is lawfully discharging an
2222 official duty, or in retaliation or on account of an exercise of
2323 official power or performance of an official duty as a public
2424 servant;
2525 (C) in retaliation against or on account of the
2626 service of another as a witness, prospective witness, informant, or
2727 person who has reported the occurrence of a crime;
2828 (D) against a person the actor knows is a process
2929 server while the person is performing a duty as a process server; or
3030 (E) against a person the actor knows is a
3131 security officer while the officer is performing a duty as a
3232 security officer; or
3333 (3) the actor is inside of or directly en route to or
3434 from a motor vehicle, as defined by Section 501.002, Transportation
3535 Code, and:
3636 (A) knowingly discharges a firearm at or in the
3737 direction of a habitation, building, or vehicle;
3838 (B) is reckless as to whether the habitation,
3939 building, or vehicle is occupied; and
4040 (C) in discharging the firearm:
4141 (i) [,]causes [serious] bodily injury to
4242 any person or damage to any property; or
4343 (ii) threatens places another in fear of
4444 immenent serious bodily injury.injury to any person.
4545 SECTION 2. The change in law made by this Act applies only
4646 to an offense committed on or after the effective date of this Act.
4747 An offense committed before the effective date of this Act is
4848 governed by the law in effect on the date the offense was committed,
4949 and the former law is continued in effect for that purpose. For
5050 purposes of this section, an offense was committed before the
5151 effective date of this Act if any element of the offense occurred
5252 before that date.
5353 SECTION 3. This Act takes effect September 1, 2023.
