| 6 | 6 | | relating to the punishment for the offense of aggravated assault. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 22.02(b), Penal Code, is amended to read |
|---|
| 9 | 9 | | as follows: |
|---|
| 10 | 10 | | (b) An offense under this section is a felony of the second |
|---|
| 11 | 11 | | degree, except that the offense is a felony of the first degree if: |
|---|
| 12 | 12 | | (1) the actor uses a deadly weapon during the |
|---|
| 13 | 13 | | commission of the assault and causes serious bodily injury to a |
|---|
| 14 | 14 | | person whose relationship to or association with the defendant is |
|---|
| 15 | 15 | | described by Section 71.0021(b), 71.003, or 71.005, Family Code; |
|---|
| 16 | 16 | | (2) regardless of whether the offense is committed |
|---|
| 17 | 17 | | under Subsection (a)(1) or (a)(2), the offense is committed: |
|---|
| 18 | 18 | | (A) by a public servant acting under color of the |
|---|
| 19 | 19 | | servant's office or employment; |
|---|
| 20 | 20 | | (B) against a person the actor knows is a public |
|---|
| 21 | 21 | | servant while the public servant is lawfully discharging an |
|---|
| 22 | 22 | | official duty, or in retaliation or on account of an exercise of |
|---|
| 23 | 23 | | official power or performance of an official duty as a public |
|---|
| 24 | 24 | | servant; |
|---|
| 25 | 25 | | (C) in retaliation against or on account of the |
|---|
| 26 | 26 | | service of another as a witness, prospective witness, informant, or |
|---|
| 27 | 27 | | person who has reported the occurrence of a crime; |
|---|
| 28 | 28 | | (D) against a person the actor knows is a process |
|---|
| 29 | 29 | | server while the person is performing a duty as a process server; or |
|---|
| 30 | 30 | | (E) against a person the actor knows is a |
|---|
| 31 | 31 | | security officer while the officer is performing a duty as a |
|---|
| 32 | 32 | | security officer; or |
|---|
| 33 | 33 | | (3) the actor is inside of or directly en route to or |
|---|
| 34 | 34 | | from a motor vehicle, as defined by Section 501.002, Transportation |
|---|
| 35 | 35 | | Code, and: |
|---|
| 36 | 36 | | (A) knowingly discharges a firearm at or in the |
|---|
| 37 | 37 | | direction of a habitation, building, or vehicle; |
|---|
| 38 | 38 | | (B) is reckless as to whether the habitation, |
|---|
| 39 | 39 | | building, or vehicle is occupied; and |
|---|
| 40 | 40 | | (C) in discharging the firearm: |
|---|
| 41 | 41 | | (i) [,]causes [serious] bodily injury to |
|---|
| 42 | 42 | | any person or damage to any property; or |
|---|
| 43 | 43 | | (ii) threatens places another in fear of |
|---|
| 44 | 44 | | immenent serious bodily injury.injury to any person. |
|---|
| 45 | 45 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 46 | 46 | | to an offense committed on or after the effective date of this Act. |
|---|
| 47 | 47 | | An offense committed before the effective date of this Act is |
|---|
| 48 | 48 | | governed by the law in effect on the date the offense was committed, |
|---|
| 49 | 49 | | and the former law is continued in effect for that purpose. For |
|---|
| 50 | 50 | | purposes of this section, an offense was committed before the |
|---|
| 51 | 51 | | effective date of this Act if any element of the offense occurred |
|---|
| 52 | 52 | | before that date. |
|---|
| 53 | 53 | | SECTION 3. This Act takes effect September 1, 2023. |
