9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 209, Property Code, is amended by adding |

11 | 11 | | Section 209.00511 to read as follows: |

12 | 12 | | Sec. 209.00511. MEMBER'S RIGHT TO SPEAK AT MEETING. (a) |
---|
13 | 13 | | Except as otherwise provided by this section, an association member |
---|
14 | 14 | | is entitled to speak at any association meeting, including a board |
---|
15 | 15 | | meeting, regardless of whether the meeting is held in person, |
---|
16 | 16 | | electronically, or by telephone. |
---|
17 | 17 | | (b) The board may place reasonable limitations on the time |
---|
18 | 18 | | and manner in which a member is allowed to speak but may not impose |
---|
19 | 19 | | requirements that restrict a member's ability to express the |
---|
20 | 20 | | member's concerns. |
---|
21 | 21 | | (c) This section does not entitle an association member to |
---|
22 | 22 | | speak at a portion of a board meeting conducted in executive |
---|
23 | 23 | | session. |
---|
24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
