66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the installation and use of tracking equipment and
99 access to certain communications by certain peace officers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 18B.001(1), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (1) "Authorized peace officer" means:
1414 (A) a sheriff or deputy sheriff;
1515 (B) a constable or deputy constable;
1616 (C) a marshal or police officer of a
1717 municipality;
1818 (D) a ranger or officer commissioned by the
1919 Public Safety Commission or the director of the department;
2020 (E) an investigator of a prosecutor's office;
2121 (F) a law enforcement agent of the Texas
2222 Alcoholic Beverage Commission;
2323 (G) a law enforcement officer commissioned by the
2424 Parks and Wildlife Commission;
2525 (H) an enforcement officer appointed by the
2626 inspector general of the Texas Department of Criminal Justice under
2727 Section 493.019, Government Code;
2828 (I) an investigator commissioned by the attorney
2929 general under Section 402.009, Government Code; [or]
3030 (J) a member of an arson investigating unit
3131 commissioned by a municipality, a county, or the state; or
3232 (K) an officer commissioned under Section
3333 37.081, Education Code, or Subchapter E, Chapter 51, Education
3434 Code.
3535 SECTION 2. This Act takes effect September 1, 2023.
