66 AN ACT
77 relating to the medical use of low-THC cannabis by patients with
88 certain medical conditions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 169.001(3), Occupations Code, is amended
1111 to read as follows:
1212 (3) "Low-THC cannabis" means the plant Cannabis sativa
1313 L., and any part of that plant or any compound, manufacture, salt,
1414 derivative, mixture, preparation, resin, or oil of that plant that
1515 contains not more than five [one] percent by weight of
1616 tetrahydrocannabinols.
1717 SECTION 2. Section 169.003, Occupations Code, is amended to
1818 read as follows:
1919 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. (a) A
2020 physician described by Section 169.002 may prescribe low-THC
2121 cannabis to a patient if:
2222 (1) the patient is a permanent resident of the state;
2323 (2) the physician complies with the registration
2424 requirements of Section 169.004; and
2525 (3) the physician certifies to the department that:
2626 (A) the patient is diagnosed with:
2727 (i) epilepsy;
2828 (ii) a seizure disorder;
2929 (iii) multiple sclerosis;
3030 (iv) spasticity;
3131 (v) amyotrophic lateral sclerosis;
3232 (vi) autism;
3333 (vii) cancer;
3434 (viii) an incurable neurodegenerative
3535 disease;
3636 (ix) post-traumatic stress disorder; [or]
3737 (x) a medical condition that is approved
3838 for a research program under Subchapter F, Chapter 487, Health and
3939 Safety Code, and for which the patient is receiving treatment under
4040 that program; or
4141 (xi) a debilitating medical condition
4242 designated by the Department of State Health Services under
4343 Subsection (b); and
4444 (B) the physician determines the risk of the
4545 medical use of low-THC cannabis by the patient is reasonable in
4646 light of the potential benefit for the patient.
4747 (b) The Department of State Health Services by rule may
4848 designate debilitating medical conditions for which a physician may
4949 prescribe low-THC cannabis under this section.
5050 SECTION 3. This Act takes effect September 1, 2023.
