66 AN ACT
77 relating to the establishment of an advisory committee to study
88 housing supply and affordability.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter HH, Chapter 2306, Government Code, is
1111 amended by adding Section 2306.806 to read as follows:
1212 Sec. 2306.806. ADVISORY COMMITTEE TO STUDY HOUSING SUPPLY
1313 AND AFFORDABILITY. (a) In this section, "political subdivision"
1414 means a county or municipality.
1515 (b) An advisory committee is established to conduct a
1616 decennial study on housing supply and affordability in this state.
1717 (c) For each study conducted under this section, the
1818 advisory committee is composed of the following 15 members:
1919 (1) two state senators appointed by the lieutenant
2020 governor;
2121 (2) two state representatives appointed by the speaker
2222 of the house of representatives;
2323 (3) the director or the director's designee;
2424 (4) two individuals appointed by the speaker of the
2525 house of representatives who represent the home building industry,
2626 one of whom must represent builders of rental housing and one of
2727 whom must represent housing built for sale;
2828 (5) two individuals appointed by the lieutenant
2929 governor who represent a political subdivision or a statewide
3030 organization that represents political subdivisions;
3131 (6) two academic professionals who study housing
3232 supply constraints, one of whom is appointed by the lieutenant
3333 governor and one of whom is appointed by the speaker of the house of
3434 representatives;
3535 (7) one individual appointed by the speaker of the
3636 house of representatives who represents a trade association
3737 consisting of members who are licensed real estate sales agents;
3838 (8) one individual appointed by the lieutenant
3939 governor who represents a statewide nonprofit housing advocacy
4040 group;
4141 (9) one individual appointed by the speaker of the
4242 house of representatives who represents a trade association
4343 consisting of members who own, build, or operate extensively in the
4444 home building industry; and
4545 (10) one individual appointed by the lieutenant
4646 governor who represents a trade association consisting of members
4747 who own, build, or operate extensively, as determined by the
4848 lieutenant governor, in the apartment industry.
4949 (d) Not later than one year preceding the date on which a
5050 decennial report is required to be submitted under Subsection (j),
5151 the appropriate appointing authorities under Subsection (c) shall
5252 appoint the members to the advisory committee in the manner
5353 required by that subsection.
5454 (e) An advisory committee member serves in that position
5555 only for the study for which the member was appointed, and the
5656 member's term expires after the applicable report is submitted
5757 under Subsection (j).
5858 (f) An advisory committee member is not entitled to
5959 compensation or reimbursement for expenses incurred in carrying out
6060 advisory committee duties.
6161 (g) For each study conducted under this section, the
6262 lieutenant governor and the speaker of the house of representatives
6363 shall each designate one member appointed under Subsection (c)(1)
6464 or (c)(2), as applicable, to serve as co-chairs of the advisory
6565 committee.
6666 (h) Each advisory committee shall meet at the call of the
6767 co-chairs appointed under Subsection (g).
6868 (i) In conducting the study under this section, the advisory
6969 committee shall:
7070 (1) evaluate existing data sources and develop new
7171 data on improving housing supply and affordability;
7272 (2) evaluate the review processes of political
7373 subdivisions that permit new housing developments;
7474 (3) evaluate the rate at which political subdivisions
7575 approve new housing developments by right;
7676 (4) evaluate the timelines by which political
7777 subdivisions approve new housing developments, factoring in any
7878 pre-submission requirements;
7979 (5) evaluate impact and permitting fees for new
8080 housing developments;
8181 (6) identify the number of each particular type of new
8282 housing development, aggregated and disaggregated by the
8383 permitting political subdivision and development type, including
8484 accessory dwelling units, small-lot homes, townhomes, mobile
8585 homes, and below market rate housing;
8686 (7) identify state grants from any source that may be
8787 used to reward political subdivisions with rules that support
8888 abundant, relatively low-cost housing construction;
8989 (8) develop methods to identify and award grants to
9090 political subdivisions based on housing market outcomes or housing
9191 policies, which may require the political subdivision to:
9292 (A) demonstrate that the political subdivision
9393 permits new housing developments at a rate that is in the top half
9494 of political subdivisions in this state;
9595 (B) demonstrate that the political subdivision
9696 permits new housing developments at a rate that is in the top half
9797 of political subdivisions in this state for relatively low-cost
9898 housing, including multifamily housing, manufactured homes,
9999 townhomes on less than 4,000 square feet of land per unit, and
100100 accessory dwelling units; or
101101 (C) zone in a manner that ensures a sufficient
102102 housing supply is created based on market demand;
103103 (9) evaluate a political subdivision's use of general
104104 obligation bond proceeds to engage in affordable housing-related
105105 projects; and
106106 (10) evaluate the efficacy of the owning and operating
107107 of employee housing by political subdivisions.
108108 (j) For each study conducted under this section, the
109109 advisory committee shall prepare and submit to the legislature a
110110 written report that summarizes the results of the study conducted
111111 under this section. The report must:
112112 (1) include specific legislative and funding
113113 recommendations to improve housing supply and affordability issues
114114 in this state; and
115115 (2) recommend policy changes at the state and local
116116 level to facilitate data collection on and improve housing supply
117117 and affordability issues in this state.
118118 (k) The advisory committee may accept gifts, grants, and
119119 donations from any source to carry out the committee's duties under
120120 this section.
121121 (l) Not later than September 1, 2024, and every 10 years
122122 thereafter, the advisory committee shall submit the report required
123123 under Subsection (j).
124124 SECTION 2. As soon as practicable after the effective date
125125 of this Act, the appropriate appointing authorities shall make the
126126 first appointments to the advisory committee as required by Section
127127 2306.806(c), Government Code, as added by this Act.
128128 SECTION 3. This Act takes effect September 1, 2023.
