55 relating to the operation of an unmanned aircraft over a
66 correctional facility or detention facility; creating a criminal
77 offense.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 38, Penal Code, is amended by adding
1010 Section 38.115 to read as follows:
1111 Sec. 38.115. OPERATION OF UNMANNED AIRCRAFT OVER
1212 CORRECTIONAL FACILITY OR DETENTION FACILITY. (a) In this section:
1313 (1) "Contraband" means any item not provided by or
1414 authorized by the operator of a correctional facility or detention
1515 facility.
1616 (2) "Correctional facility" means:
1717 (A) a confinement facility operated by or under
1818 contract with any division of the Texas Department of Criminal
1919 Justice;
2020 (B) a municipal or county jail;
2121 (C) a confinement facility operated by or under
2222 contract with the Federal Bureau of Prisons; or
2323 (D) a secure correctional facility or secure
2424 detention facility, as defined by Section 51.02, Family Code.
2525 (3) "Detention facility" means a facility operated by
2626 or under contract with United States Immigration and Customs
2727 Enforcement for the purpose of detaining aliens and placing them in
2828 removal proceedings.
2929 (b) A person commits an offense if the person intentionally
3030 or knowingly:
3131 (1) operates an unmanned aircraft over a correctional
3232 facility or detention facility and the unmanned aircraft is not
3333 higher than 400 feet above ground level;
3434 (2) allows an unmanned aircraft to make contact with a
3535 correctional facility or detention facility, including any person
3636 or object on the premises of or within the facility; or
3737 (3) allows an unmanned aircraft to come within a
3838 distance of a correctional facility or detention facility that is
3939 close enough to interfere with the operations of or cause a
4040 disturbance to the facility.
4141 (c) This section does not apply to conduct described by
4242 Subsection (b) that is committed by:
4343 (1) the federal government, this state, or a
4444 governmental entity;
4545 (2) a person under contract with or otherwise acting
4646 under the direction or on behalf of the federal government, this
4747 state, or a governmental entity;
4848 (3) a person who has the prior written consent of the
4949 owner or operator of the correctional facility or detention
5050 facility;
5151 (4) a law enforcement agency; or
5252 (5) a person under contract with or otherwise acting
5353 under the direction or on behalf of a law enforcement agency.
5454 (d) An offense under this section is a Class B misdemeanor,
5555 except that the offense is:
5656 (1) a Class A misdemeanor if the actor has previously
5757 been convicted under this section; or
5858 (2) a state jail felony if, during the commission of
5959 the offense, the actor used the unmanned aircraft to:
6060 (A) provide contraband to a person in the custody
6161 of the correctional facility or detention facility; or
6262 (B) otherwise introduce contraband into the
6363 correctional facility or detention facility.
6464 SECTION 2. The heading to Section 423.0045, Government
6565 Code, is amended to read as follows:
6666 Sec. 423.0045. OFFENSE: OPERATION OF UNMANNED AIRCRAFT OVER
6767 [CORRECTIONAL FACILITY, DETENTION FACILITY, OR] CRITICAL
6868 INFRASTRUCTURE FACILITY.
6969 SECTION 3. Sections 423.0045(b) and (c), Government Code,
7070 are amended to read as follows:
7171 (b) A person commits an offense if the person intentionally
7272 or knowingly:
7373 (1) operates an unmanned aircraft over a [correctional
7474 facility, detention facility, or] critical infrastructure facility
7575 and the unmanned aircraft is not higher than 400 feet above ground
7676 level;
7777 (2) allows an unmanned aircraft to make contact with a
7878 [correctional facility, detention facility, or] critical
7979 infrastructure facility, including any person or object on the
8080 premises of or within the facility; or
8181 (3) allows an unmanned aircraft to come within a
8282 distance of a [correctional facility, detention facility, or]
8383 critical infrastructure facility that is close enough to interfere
8484 with the operations of or cause a disturbance to the facility.
8585 (c) This section does not apply to[:
8686 [(1)] conduct described by Subsection (b) that
8787 [involves a correctional facility, detention facility, or critical
8888 infrastructure facility and] is committed by:
8989 (1) [(A)] the federal government, the state, or a
9090 governmental entity;
9191 (2) [(B)] a person under contract with or otherwise
9292 acting under the direction or on behalf of the federal government,
9393 the state, or a governmental entity;
9494 (3) [(C)] a law enforcement agency;
9595 (4) [(D)] a person under contract with or otherwise
9696 acting under the direction or on behalf of a law enforcement agency;
9797 (5) [or
9898 [(E)] an operator of an unmanned aircraft that is
9999 being used for a commercial purpose, if the operation is conducted
100100 in compliance with:
101101 (A) [(i)] each applicable Federal Aviation
102102 Administration rule, restriction, or exemption; and
103103 (B) [(ii)] all required Federal Aviation
104104 Administration authorizations;
105105 (6) [or
106106 [(2) conduct described by Subsection (b) that involves
107107 a critical infrastructure facility and is committed by:
108108 [(A)] an owner or operator of the critical
109109 infrastructure facility;
110110 (7) [(B)] a person under contract with or otherwise
111111 acting under the direction or on behalf of an owner or operator of
112112 the critical infrastructure facility;
113113 (8) [(C)] a person who has the prior written consent
114114 of the owner or operator of the critical infrastructure facility;
115115 or
116116 (9) [(D)] the owner or occupant of the property on
117117 which the critical infrastructure facility is located or a person
118118 who has the prior written consent of the owner or occupant of that
119119 property.
120120 SECTION 4. Sections 423.0045(a)(1) and (3), Government
121121 Code, are repealed.
122122 SECTION 5. The change in law made by this Act to Section
123123 423.0045, Government Code, applies only to an offense committed on
124124 or after the effective date of this Act. An offense committed
125125 before the effective date of this Act is governed by the law in
126126 effect on the date the offense was committed, and the former law is
127127 continued in effect for that purpose. For purposes of this section,
128128 an offense was committed before the effective date of this Act if
129129 any element of the offense was committed before that date.
130130 SECTION 6. This Act takes effect September 1, 2023.
