| 7 | 7 | | relating to the authority of a municipality to annex area qualified |

| 8 | 8 | | for agricultural or wildlife management use or as timberland. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 43.016(b), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) A municipality may not annex an area to which this |
|---|
| 13 | 13 | | section applies without the written consent of each owner of the |
|---|
| 14 | 14 | | area being annexed [unless: |
|---|
| 15 | 15 | | [(1) the municipality offers to make a development |
|---|
| 16 | 16 | | agreement with the landowner under Section 212.172 that would: |
|---|
| 17 | 17 | | [(A) guarantee the continuation of the |
|---|
| 18 | 18 | | extraterritorial status of the area; and |
|---|
| 19 | 19 | | [(B) authorize the enforcement of all |
|---|
| 20 | 20 | | regulations and planning authority of the municipality that do not |
|---|
| 21 | 21 | | interfere with the use of the area for agriculture, wildlife |
|---|
| 22 | 22 | | management, or timber; and |
|---|
| 23 | 23 | | [(2) the landowner declines to make the agreement |
|---|
| 24 | 24 | | described by Subdivision (1)]. |
|---|
| 25 | 25 | | SECTION 2. Sections 43.016(c), (d), and (e), Local |
|---|
| 26 | 26 | | Government Code, are repealed. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect September 1, 2023. |
