A BILL TO BE ENTITLED
AN ACT
relating to the authority of a county to maintain a sewer utility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 562.015, Local Government Code, is
amended to read as follows:
Sec. 562.015. COUNTY WATER AND SEWER UTILITY. (a) An
affected county, as defined by Section 16.341, Water Code, may own,
operate, or maintain a water or sewer utility in the same manner as
a municipality under Chapter 552.
(b) Any county may own, operate, or maintain a sewer utility
in the unincorporated area of the county in the same manner as a
municipality under Chapter 552. The county must comply with all
provisions of Chapter 13, Water Code, that apply to an affected
county.
SECTION 2. This Act takes effect September 1, 2023.
