| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 562.015, Local Government Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 562.015. COUNTY WATER AND SEWER UTILITY. (a) An |
|---|
| 12 | 12 | | affected county, as defined by Section 16.341, Water Code, may own, |
|---|
| 13 | 13 | | operate, or maintain a water or sewer utility in the same manner as |
|---|
| 14 | 14 | | a municipality under Chapter 552. |
|---|
| 15 | 15 | | (b) Any county may own, operate, or maintain a sewer utility |
|---|
| 16 | 16 | | in the unincorporated area of the county in the same manner as a |
|---|
| 17 | 17 | | municipality under Chapter 552. The county must comply with all |
|---|
| 18 | 18 | | provisions of Chapter 13, Water Code, that apply to an affected |
|---|
| 19 | 19 | | county. |

| 20 | 20 | | SECTION 2. This Act takes effect September 1, 2023. |
