| 6 | 6 | | relating to eligibility for the school safety allotment under the |
|---|
| 7 | 7 | | public school finance system. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 48.115(a), Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) From funds appropriated for that purpose, the |
|---|
| 12 | 12 | | commissioner shall provide to an eligible [a] school district an |
|---|
| 13 | 13 | | annual allotment in the amount provided by appropriation for each |
|---|
| 14 | 14 | | student in average daily attendance. |
|---|
| 15 | 15 | | (b) To be eligible to receive an allotment under this |
|---|
| 16 | 16 | | section, a school district must ensure that: |
|---|
| 17 | 17 | | (1) during regular school hours at least one security |
|---|
| 18 | 18 | | officer armed with a firearm is present at each district campus. |
|---|
| 19 | 19 | | For purposes of this subsection, a security officer must be: |
|---|
| 20 | 20 | | (A) a school district peace officer; |
|---|
| 21 | 21 | | (B) a school resource officer; or |
|---|
| 22 | 22 | | (C) a commissioned peace officer employed as |
|---|
| 23 | 23 | | security personnel under Section 37.081; and |
|---|
| 24 | 24 | | (2) at least one school marshal, school resource |
|---|
| 25 | 25 | | officer, commissioned peace officer or school district peace |
|---|
| 26 | 26 | | officer, armed with a firearm and who has at minimum received |
|---|
| 27 | 27 | | training comparable to section 1701.260(c), Occupations Code, is |
|---|
| 28 | 28 | | appointed, assigned, or employed for every 200 enrolled students. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if this Act |
|---|
| 30 | 30 | | receives a vote of two-thirds of all the members elected to each |
|---|
| 31 | 31 | | house, as provided by Section 39, Article III, Texas Constitution. |
|---|
| 32 | 32 | | If this Act does not receive the vote necessary for immediate |
|---|
| 33 | 33 | | effect, this Act takes effect September 1, 2023. |
