44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to eligibility for the school safety allotment under the
77 public school finance system.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 48.115(a), Education Code, is amended to
1010 read as follows:
1111 (a) From funds appropriated for that purpose, the
1212 commissioner shall provide to an eligible [a] school district an
1313 annual allotment in the amount provided by appropriation for each
1414 student in average daily attendance.
1515 (b) To be eligible to receive an allotment under this
1616 section, a school district must ensure that:
1717 (1) during regular school hours at least one security
1818 officer armed with a firearm is present at each district campus.
1919 For purposes of this subsection, a security officer must be:
2020 (A) a school district peace officer;
2121 (B) a school resource officer; or
2222 (C) a commissioned peace officer employed as
2323 security personnel under Section 37.081; and
2424 (2) at least one school marshal, school resource
2525 officer, commissioned peace officer or school district peace
2626 officer, armed with a firearm and who has at minimum received
2727 training comparable to section 1701.260(c), Occupations Code, is
2828 appointed, assigned, or employed for every 200 enrolled students.
2929 SECTION 2. This Act takes effect immediately if this Act
3030 receives a vote of two-thirds of all the members elected to each
3131 house, as provided by Section 39, Article III, Texas Constitution.
3232 If this Act does not receive the vote necessary for immediate
3333 effect, this Act takes effect September 1, 2023.
