99 relating to the cancellation of certain consumer transactions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 601.002, Business & Commerce Code, is
1212 amended to read as follows:
1313 Sec. 601.002. APPLICABILITY OF CHAPTER; EXCEPTION. (a)
1414 This chapter applies only to a consumer transaction in which:
1515 (1) the merchant or the merchant's agent is not
1616 regulated by the Texas Department of Insurance or the Texas
1717 Department of Licensing and Regulation and engages in a personal
1818 solicitation of a sale to the consumer at a place other than the
1919 merchant's place of business if:
2020 (A) the consumer is not a customer of the
2121 merchant, or of an affiliate of the merchant, at the time of the
2222 solicitation; or
2323 (B) the consumer has not previously placed an
2424 order for goods or services with the merchant, an affiliate of the
2525 merchant, or the merchant's agent;
2626 (2) the consumer's agreement or offer to purchase is
2727 given to the merchant or the merchant's agent at a place other than
2828 the merchant's place of business if the merchant is not regulated by
2929 the Texas Department of Insurance or the Texas Department of
3030 Licensing and Regulation, and:
3131 (A) the consumer is not a customer of the
3232 merchant, or of an affiliate of the merchant, at the time of the
3333 solicitation described by Subdivision (1); or
3434 (B) the consumer has not previously placed an
3535 order for goods or services with the merchant, an affiliate of the
3636 merchant, or the merchant's agent; and
3737 (3) the agreement or offer is for:
3838 (A) the purchase of goods or services for
3939 consideration that exceeds $25, payable in installments or in cash;
4040 or
4141 (B) the purchase of real property for
4242 consideration that exceeds $100, payable in installments or in
4343 cash.
4444 (b) Notwithstanding Subsection (a), this chapter does not
4545 apply to:
4646 (1) a purchase of farm equipment;
4747 (2) an insurance sale regulated by the Texas
4848 Department of Insurance;
4949 (3) a sale of goods or services made:
5050 (A) under a preexisting revolving charge account
5151 or retail charge agreement; [or]
5252 (B) after negotiations between the parties at a
5353 business establishment in a fixed location where goods or services
5454 are offered or exhibited for sale; or
5555 (C) entirely by mail, Internet, or telephone and
5656 without any other contact between the buyer and the seller or the
5757 seller's representative before delivery of the goods or performance
5858 of the services; or
5959 (4) a sale of real property if:
6060 (A) the purchaser is represented by a licensed
6161 attorney;
6262 (B) the transaction is negotiated by a licensed
6363 real estate broker; or
6464 (C) the transaction is negotiated at a place
6565 other than the consumer's residence by the person who owns the
6666 property.
6767 SECTION 2. The changes in law made by this Act apply only to
6868 a consumer transaction that occurs on or after the effective date of
6969 this Act. A consumer transaction that occurs before the effective
7070 date of this Act is governed by the law in effect on the date the
7171 transaction occurred, and the former law is continued in effect for
7272 that purpose.
7373 SECTION 3. This Act takes effect September 1, 2023.
