55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a business to file electronic
88 documents with a county clerk that accepts electronic filing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 195.003(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) The following persons may file electronic documents or
1313 other documents electronically for recording with a county clerk
1414 that accepts electronic filing and recording under this chapter:
1515 (1) an attorney licensed in this state;
1616 (2) [a bank, savings and loan association, savings
1717 bank, or credit union doing business under laws of the United States
1818 or this state;
1919 [(3)] a federally chartered lending institution, a
2020 federal government-sponsored entity, an instrumentality of the
2121 federal government, or a person approved as a mortgagee by the
2222 United States to make federally insured loans;
2323 (3) [(4)] a person licensed to make regulated loans in
2424 this state;
2525 (4) [(5) a title insurance company or title insurance
2626 agent licensed to do business in this state;
2727 [(6)] an agency of this state;
2828 (5) [or
2929 [(7)] a municipal clerk; or
3030 (6) a business, including:
3131 (A) a bank, savings and loan association, savings
3232 bank, or credit union doing business under laws of the United States
3333 or this state;
3434 (B) a title insurance company or title insurance
3535 agent licensed to do business in this state; and
3636 (C) a utility, including a nonprofit utility
3737 corporation or cooperative.
3838 SECTION 2. The changes in law made by this Act apply only to
3939 electronic documents filed on or after the effective date of this
4040 Act. Electronic documents filed before the effective date of this
4141 Act are governed by the law in effect on the date the document was
4242 filed, and the former law is continued in effect for that purpose.
4343 SECTION 3. This Act takes effect September 1, 2023.
