| 7 | 7 | | relating to the authority of a business to file electronic |
|---|
| 8 | 8 | | documents with a county clerk that accepts electronic filing. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 195.003(a), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) The following persons may file electronic documents or |
|---|
| 13 | 13 | | other documents electronically for recording with a county clerk |
|---|
| 14 | 14 | | that accepts electronic filing and recording under this chapter: |
|---|
| 15 | 15 | | (1) an attorney licensed in this state; |
|---|
| 16 | 16 | | (2) [a bank, savings and loan association, savings |
|---|
| 17 | 17 | | bank, or credit union doing business under laws of the United States |
|---|
| 18 | 18 | | or this state; |
|---|
| 19 | 19 | | [(3)] a federally chartered lending institution, a |
|---|
| 20 | 20 | | federal government-sponsored entity, an instrumentality of the |
|---|
| 21 | 21 | | federal government, or a person approved as a mortgagee by the |
|---|
| 22 | 22 | | United States to make federally insured loans; |
|---|
| 23 | 23 | | (3) [(4)] a person licensed to make regulated loans in |
|---|
| 24 | 24 | | this state; |
|---|
| 25 | 25 | | (4) [(5) a title insurance company or title insurance |
|---|
| 26 | 26 | | agent licensed to do business in this state; |
|---|
| 27 | 27 | | [(6)] an agency of this state; |
|---|
| 28 | 28 | | (5) [or |
|---|
| 29 | 29 | | [(7)] a municipal clerk; or |
|---|
| 30 | 30 | | (6) a business, including: |
|---|
| 31 | 31 | | (A) a bank, savings and loan association, savings |
|---|
| 32 | 32 | | bank, or credit union doing business under laws of the United States |
|---|
| 33 | 33 | | or this state; |
|---|
| 34 | 34 | | (B) a title insurance company or title insurance |
|---|
| 35 | 35 | | agent licensed to do business in this state; and |
|---|
| 36 | 36 | | (C) a utility, including a nonprofit utility |
|---|
| 37 | 37 | | corporation or cooperative. |
|---|
| 38 | 38 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 39 | 39 | | electronic documents filed on or after the effective date of this |
|---|
| 40 | 40 | | Act. Electronic documents filed before the effective date of this |
|---|
| 41 | 41 | | Act are governed by the law in effect on the date the document was |
|---|
| 42 | 42 | | filed, and the former law is continued in effect for that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
