| 7 | 7 | | relating to the type of newspaper required for the publication of |

| 8 | 8 | | notices by governmental entities or representatives in certain |
|---|
| 9 | 9 | | counties. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2051.0441(b), Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) The newspaper in which a notice is published under this |
|---|
| 14 | 14 | | section must: |
|---|
| 15 | 15 | | (1) devote not less than 20 percent of its total column |
|---|
| 16 | 16 | | lineage to general interest items; |
|---|
| 17 | 17 | | (2) be published at least once each week; |
|---|
| 18 | 18 | | (3) meet one of the following requirements: |
|---|
| 19 | 19 | | (A) be entered as periodical postal matter in the |
|---|
| 20 | 20 | | county where published; |
|---|
| 21 | 21 | | (B) [or] have a mailed or delivered circulation |
|---|
| 22 | 22 | | of at least 51 percent of the residences in the county where |
|---|
| 23 | 23 | | published; or |
|---|
| 24 | 24 | | (C) for notices by a governmental entity or |
|---|
| 25 | 25 | | representative of the county or a political subdivision located in |
|---|
| 26 | 26 | | the county, be published in the county and designated by, as |
|---|
| 27 | 27 | | applicable, commissioners court order or official action of the |
|---|
| 28 | 28 | | governing body of the political subdivision as the newspaper for |
|---|
| 29 | 29 | | publication of notices; and |
|---|
| 30 | 30 | | (4) have been published regularly and continuously for |
|---|
| 31 | 31 | | at least 12 months before the governmental entity or representative |
|---|
| 32 | 32 | | publishes notice. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
