| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 51.91922 to read as follows: |
|---|
| 14 | 14 | | Sec. 51.91922. USE OF CIGARETTE, E-CIGARETTE, OR TOBACCO |
|---|
| 15 | 15 | | PRODUCT PROHIBITED. (a) In this section: |

| 16 | 16 | | (1) "Cigarette" has the meaning assigned by Section |
|---|
| 17 | 17 | | 154.001, Tax Code. |
|---|
| 18 | 18 | | (2) "E-cigarette" has the meaning assigned by Section |
|---|
| 19 | 19 | | 161.081, Health and Safety Code. |
|---|
| 20 | 20 | | (3) "Institution of higher education" has the meaning |
|---|
| 21 | 21 | | assigned by Section 61.003. |
|---|
| 22 | 22 | | (4) "Tobacco product" has the meaning assigned by |
|---|
| 23 | 23 | | Section 155.001, Tax Code. |
|---|
| 24 | 24 | | (b) An institution of higher education may adopt a policy |
|---|
| 25 | 25 | | prohibiting the use of a cigarette, e-cigarette, or tobacco product |
|---|
| 26 | 26 | | on the grounds of, or in any building located on, the institution's |
|---|
| 27 | 27 | | campus. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2023. |
