6 | 6 | | information regarding clients of family violence shelter centers, |

7 | 7 | | victims of trafficking shelter centers, and sexual assault programs |

8 | 8 | | and survivors of family violence, domestic violence, and sexual |
---|
9 | 9 | | assault. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 552.138(a), Government Code, is amended |
---|
12 | 12 | | by adding Subdivision (1-a) to read as follows: |
---|
13 | 13 | | (1-a) "License" means a license, certificate, |
---|
14 | 14 | | registration, permit, or other authorization that: |
---|
15 | 15 | | (A) is issued by a governmental body; and |
---|
16 | 16 | | (B) a person must obtain to practice or engage in |
---|
17 | 17 | | a particular business, occupation, or profession. |
---|
18 | 18 | | SECTION 2. Section 552.138, Government Code, is amended by |
---|
19 | 19 | | adding Subsections (f) and (g) to read as follows: |
---|
20 | 20 | | (f) Notwithstanding any other law, a governmental body may |
---|
21 | 21 | | not sell or otherwise release the name, home or business address, |
---|
22 | 22 | | place of employment, telephone number, electronic mail address, |
---|
23 | 23 | | social security number, date of birth, driver's license or state |
---|
24 | 24 | | identification number, passport number, emergency contact |
---|
25 | 25 | | information, or numeric identifier of a person who: |
---|
26 | 26 | | (1) holds, previously held, or is an applicant for a |
---|
27 | 27 | | license issued by the governmental body; and |
---|
28 | 28 | | (2) notifies the governmental body on a form provided |
---|
29 | 29 | | by the office of the attorney general or the governmental body that |
---|
30 | 30 | | the person: |
---|
31 | 31 | | (A) is a current or former client of a family |
---|
32 | 32 | | violence shelter center, victims of trafficking shelter center, or |
---|
33 | 33 | | sexual assault program or is a survivor of family violence, |
---|
34 | 34 | | domestic violence, or sexual assault; and |
---|
35 | 35 | | (B) chooses to restrict public access to the |
---|
36 | 36 | | information. |
---|
37 | 37 | | (g) A governmental body may redact information described by |
---|
38 | 38 | | Subsection (f) from a response to a request for a list or directory |
---|
39 | 39 | | of license holders, former license holders, or license applicants |
---|
40 | 40 | | without the necessity of requesting a decision from the attorney |
---|
41 | 41 | | general under Subchapter G. |
---|
42 | 42 | | SECTION 3. As soon as practicable after the effective date |
---|
43 | 43 | | of this Act, the office of the attorney general shall prepare the |
---|
44 | 44 | | form described by Section 552.138(f)(2), Government Code, as added |
---|
45 | 45 | | by this Act, make the form available on the attorney general's |
---|
46 | 46 | | website, and notify family violence shelter centers, victims of |
---|
47 | 47 | | trafficking shelter centers, and sexual assault programs of the |
---|
48 | 48 | | availability and purpose of the form. |
---|
49 | 49 | | SECTION 4. This Act takes effect September 1, 2023. |
