55 relating to prohibited local regulation with respect to a firearm
66 or air gun.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 229.001(a), Local Government Code, is
99 amended to read as follows:
1010 (a) Notwithstanding any other law, including Section 43.002
1111 of this code and Chapter 251, Agriculture Code, a municipality may
1212 not adopt or enforce regulations that:
1313 (1) relate [relating] to:
1414 (A) [(1)] the transfer, possession, wearing,
1515 carrying, ownership, storage, transportation, licensing, or
1616 registration of firearms, air guns, knives, ammunition, or firearm
1717 or air gun supplies or accessories;
1818 (B) [(2)] commerce in firearms, air guns,
1919 knives, ammunition, or firearm or air gun supplies or accessories;
2020 or
2121 (C) [(3)] the discharge of a firearm or air gun
2222 at a sport shooting range; or
2323 (2) require an owner of a firearm to obtain liability
2424 insurance coverage for damages resulting from negligent or wilful
2525 acts involving the use of the firearm.
2626 SECTION 2. Section 235.023, Local Government Code, is
2727 amended to read as follows:
2828 Sec. 235.023. PROHIBITED REGULATIONS. This subchapter
2929 does not authorize the commissioners court to:
3030 (1) regulate the transfer, ownership, possession,
3131 [or] transportation, licensing, or registration of firearms or air
3232 guns; or
3333 (2) [and does not authorize the court to] require an
3434 owner of a firearm to obtain liability insurance coverage for
3535 damages resulting from negligent or wilful acts involving the use
3636 of the firearm [the registration of firearms or air guns].
3737 SECTION 3. Section 236.002(a), Local Government Code, is
3838 amended to read as follows:
3939 (a) Notwithstanding any other law, including Chapter 251,
4040 Agriculture Code, a county may not adopt or enforce regulations
4141 that:
4242 (1) relate [relating] to:
4343 (A) [(1)] the transfer, possession, wearing,
4444 carrying, ownership, storage, transportation, licensing, or
4545 registration of firearms, air guns, knives, ammunition, or firearm
4646 or air gun supplies or accessories;
4747 (B) [(2)] commerce in firearms, air guns,
4848 knives, ammunition, or firearm or air gun supplies or accessories;
4949 or
5050 (C) [(3)] the discharge of a firearm or air gun
5151 at a sport shooting range; or
5252 (2) require an owner of a firearm to obtain liability
5353 insurance coverage for damages resulting from negligent or wilful
5454 acts involving the use of the firearm.
5555 SECTION 4. The changes in law made by this Act apply to an
5656 ordinance, order, or regulation that is adopted or enforced before,
5757 on, or after the effective date of this Act.
5858 SECTION 5. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2023.
