| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 411.173(b), Government Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (b) A valid license to carry a handgun issued by any other |
|---|
| 15 | 15 | | state is recognized in this state. The governor shall negotiate [an |
|---|
| 16 | 16 | | agreement] with any other state an agreement that provides for the |
|---|
| 17 | 17 | | reciprocal recognition [issuance] of a license to carry a handgun |
|---|
| 18 | 18 | | if the other state requires such an agreement before recognizing a |
|---|
| 19 | 19 | | license to carry a handgun issued by this state [under which a |
|---|
| 20 | 20 | | license issued by the other state is recognized in this state or |
|---|
| 21 | 21 | | shall issue a proclamation that a license issued by the other state |
|---|
| 22 | 22 | | is recognized in this state if the attorney general of the State of |
|---|
| 23 | 23 | | Texas determines that a background check of each applicant for a |
|---|
| 24 | 24 | | license issued by that state is initiated by state or local |
|---|
| 25 | 25 | | authorities or an agent of the state or local authorities before the |
|---|
| 26 | 26 | | license is issued. For purposes of this subsection, "background |
|---|
| 27 | 27 | | check" means a search of the National Crime Information Center |
|---|
| 28 | 28 | | database and the Interstate Identification Index maintained by the |
|---|
| 29 | 29 | | Federal Bureau of Investigation]. The department shall publish on |
|---|
| 30 | 30 | | its Internet website and annually update a list of states in which a |
|---|
| 31 | 31 | | license to carry a handgun issued by this state is recognized. |
|---|
| 32 | 32 | | SECTION 2. Sections 411.173(c) and (d), Government Code, |
|---|
| 33 | 33 | | are repealed. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2023. |
