88 AN ACT
99 relating to the recognition of a handgun license issued by another
1010 state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 411.173(b), Government Code, is amended
1313 to read as follows:
1414 (b) A valid license to carry a handgun issued by any other
1515 state is recognized in this state. The governor shall negotiate [an
1616 agreement] with any other state an agreement that provides for the
1717 reciprocal recognition [issuance] of a license to carry a handgun
1818 if the other state requires such an agreement before recognizing a
1919 license to carry a handgun issued by this state [under which a
2020 license issued by the other state is recognized in this state or
2121 shall issue a proclamation that a license issued by the other state
2222 is recognized in this state if the attorney general of the State of
2323 Texas determines that a background check of each applicant for a
2424 license issued by that state is initiated by state or local
2525 authorities or an agent of the state or local authorities before the
2626 license is issued. For purposes of this subsection, "background
2727 check" means a search of the National Crime Information Center
2828 database and the Interstate Identification Index maintained by the
2929 Federal Bureau of Investigation]. The department shall publish on
3030 its Internet website and annually update a list of states in which a
3131 license to carry a handgun issued by this state is recognized.
3232 SECTION 2. Sections 411.173(c) and (d), Government Code,
3333 are repealed.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
