55 relating to a statement by the secretary of state regarding the
66 furnishing of certain personal information on an application for a
77 ballot to be voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 84.011, Election Code, is amended by
1010 amending Subsection (a) and adding Subsection (c) to read as
1111 follows:
1212 (a) The officially prescribed application form for an early
1313 voting ballot must include:
1414 (1) immediately preceding the signature space the
1515 statement: "I certify that the information given in this
1616 application is true, and I understand that giving false information
1717 in this application is a crime.";
1818 (2) a statement informing the applicant of the
1919 offenses prescribed by Sections 84.003 and 84.004;
2020 (3) spaces for entering an applicant's voter
2121 registration number and county election precinct of registration,
2222 with a statement informing the applicant that failure to furnish
2323 that information does not invalidate the application;
2424 (3-a) a space for entering the information required
2525 under Section 84.002(a)(1-a); and
2626 (4) on an application for a ballot to be voted by mail:
2727 (A) a space for an applicant applying on the
2828 ground of absence from the county of residence to indicate the date
2929 on or after which the applicant can receive mail at the address
3030 outside the county;
3131 (B) a space for indicating the fact that an
3232 applicant whose application is signed by a witness cannot make the
3333 applicant's mark and a space for indicating the relationship or
3434 lack of relationship of the witness to the applicant;
3535 (C) a space for entering an applicant's telephone
3636 number, with:
3737 (i) a statement informing the applicant
3838 that failure to furnish that information does not invalidate the
3939 application; and
4040 (ii) a statement prescribed by the
4141 secretary of state explaining the benefits of furnishing that
4242 information, including how that information assists the early
4343 voting clerk;
4444 (D) a space or box for an applicant applying on
4545 the ground of age or disability to indicate that the address to
4646 which the ballot is to be mailed is the address of a facility or
4747 relative described by Section 84.002(a)(3), if applicable;
4848 (E) a space or box for an applicant applying on
4949 the ground of confinement in jail or involuntary civil commitment
5050 to indicate that the address to which the ballot is to be mailed is
5151 the address of a relative described by Section 84.002(a)(4) or (7),
5252 if applicable;
5353 (F) a space for an applicant applying on the
5454 ground of age or disability to indicate if the application is an
5555 application under Section 86.0015;
5656 (G) spaces for entering the signature, printed
5757 name, and residence address of any person assisting the applicant;
5858 (H) a statement informing the applicant of the
5959 condition prescribed by Section 81.005; and
6060 (I) a statement informing the applicant of the
6161 requirement prescribed by Section 86.003(c).
6262 (c) The secretary of state shall make the statement
6363 prescribed by Subsection (a)(4)(C)(ii) available on the
6464 secretary's Internet website.
6565 SECTION 2. This Act takes effect September 1, 2023.
